For Iraqi women, America's promise of democracy is anything but liberation

A decade on from the US-led invasion of Iraq, the destruction caused by foreign occupation and the subsequent regime has had a massive impact on Iraqis' daily life – the most disturbing example of which is violence against women. At the same time, the sectarian regime's policy on religious garb is forcing women to retire their hard-earned rights across the spectrum: employment, freedom of movement, civil marriage, welfare benefits, and the right to education and health services.
Instead, they are seeking survival and protection for themselves and their families. But for many, the violence they face comes from the very institution that should guarantee their safety: the government. Iraqi regime officials often echo the same denials of the US-UK occupation authorities, saying that there are few or no women detainees. An increasing number of international and Iraqi human rights organizations reports otherwise.
The plight of women detainees was the starting point for the mass protests that have spread through many Iraqi provinces since 25 December 2012. Their treatment by the security forces has been a bleeding wound – and one shrouded in secrecy, especially since 2003. Women have been routinely detained as hostages – a tactic to force their male loved ones to surrender to security forces, or confess to crimes ascribed to them. Banners and placards carried by hundreds of thousands of protesters portray images of women behind bars pleading for justice.
According to Mohamed al-Dainy, an Iraqi MP, there was 1,053 cases of documented rape (pdf) cases by the occupying troops and Iraqi forces between 2003 and 2007. Lawyers acting on behalf of former detainees say that UK detention practices between 2003 and 2008 included unlawful killings, beatings, hooding, sleep deprivation, forced nudity and sexual humiliation, sometimes involving women and children. The abuses were endemic, allege the detainees' lawyers, arising from the "systems, management culture and training" of the British military.
These same occupation forces trained Iraqi forces. Abuses often occurred under the supervision of US commanders, who were unwilling to intervene, as the Washington Post reported:
"Of all the bloodshed in Iraq, none may be more disturbing than the campaign of torture and murder being conducted by US-trained government police forces."
In the aftermath of Abu Ghraib, detainees were handed over to Iraqi forces. This enabled them to be tortured, while occupation troops could disclaim responsibility.
Today, Iraq can boast one of the highest execution rates in the world. In a single day, 19 January 2012, 34 individuals, including two women, were executed – an act described by UN High Commissioner for Human RightsNavi Pillay as shocking:
"Given the lack of transparency in court proceedings, major concerns about due process and fairness of trials, and the very wide range of offences for which the death penalty can be imposed in Iraq."
No wonder, ten years after the invasion, the Iraqi authorities are accused by US-based Human Rights Watch of "violating with impunity the rights of Iraq's most vulnerable citizens, especially women and detainees". HRW's account is echoed by a report by the Iraqi parliament's own human rights and women, family and children's committees, which found that there are 1,030 women detainees suffering from widespread abuse, including threats of rape.
Responding to these findings, Prime Minister Nouri al-Maliki threatened to "arrest those members of parliament who had discussed the violence against women detainees". Meanwhile, Deputy Prime Minister Hussain al-Shahristani has acknowledged that there are 13,000 prisoners in custody accused of terror offences, but he only mentioned women detainees in passing:
"We transferred all women prisoners to prisons in their home provinces."
Al-Shahristani's statement is one in a long list of contradictory and misleading statements by the regime's most senior officials – from al-Maliki speaking of "not more than a handful of women terrorists", to his contradictory promise that he will pardon all "women detainees who have been arrested without a judicial order or in lieu of a crime committed by some of their male relatives". That assurance was followed by parading nine women, cloaked in black from head to toe, on the official state TV channel, al-Iraqiya, as a gesture of the regime's "good will".
Protesters and Iraqi human rights organizations estimate that there are as many as 5,000 female detainees. The truth is leaking out, drip by drip. A few weeks ago, 168 women detainees were released and there were promises of another 32 waiting to be released. No one accused of torture, rape or abuse has yet been brought to justice.
And it was all supposed to be so different. That was what Iraqi women were promised.
A political quota system, established in post-invasion Iraq, was designed to ensure that at least 25% of the members of the parliament were women. That was applauded as a great achievement of the "New Iraq" – compared with 8% female representation under Ba'athist regime. But this token statistic has repeatedly been trotted out to cover up the regime's crimes against women.
In reality, the al-Maliki government has since dispensed with the quota for government posts: there is only one woman minister among 44 positions. But even this appointment contains a grim irony: the minister for women's affairs, Ibtihal al-Zaidi, didn't hesitate to announce:
"I am against the equality between men and woman. If women are equal to men, they are going to lose a lot."
Perhaps unsurprisingly, many women's organisations have demanded the abolition of the ministry of women's affairs after the minister adopted a position against, rather than for, women's rights.
Human rights, including women's rights, are a litmus test for democracy. Statements by senior officials, including the prime minister himself, show that – contrary to what some Iraqis had hoped for – the "liberators" have actually set the conditions for the continuity of injustice. And that, in turn, gives rise to extremism.

نستنكر وبشدة العمل البربري الذي قامت به حكومة المنطقة الخضراء متمثلة بقيادة شرطة بغداد التي قامت بإهانة المعتقل ليث الدليمي ورفاقه في قاعة المؤتمر الصحفي وقبلها تعذيبهم لأخذ اعترافات كاذبة وسياسية منهم , وبغض النظر إن كان ليث الدليمي بريء أم متهم فان ما حصل يوم أمس في القاعة من إذلال وإهانة وتمييز طائفي مقيت لا يجب أن يقف عندها أي عراقي غيور وشريف , وإذا ما عرفنا أن ليث الدليمي هو عضو مجلس محافظة بغداد فهنا يكون تساؤلنا ماذا حصل ويحصل لباقي المعتقلين الذين يقبعون منذ سنوات في سجون العراق من زاخو إلى الفاو وإذ كان ليث قد تجرئ واسمع صوته للعالم فمن سيوصل صوت المظلومين في غياهب السجون ؟ نحن في الحركة الشعبية لإنقاذ العراق إذ نستنكر هذا العمل البربري نؤكد على إنه لا يوجد شخص لديه حصانة في العراق لا مواطن ولا سياسي في ضل هذه الحكومة القمعية المستبدة وان كنا نمني النفس بأن يتذوق كل من دخل العملية السياسية ما ذاقه المعتقلين في سجون الحكومة منذ عام 2003 ليعلموا أي حيف وضيم وقع على أبناء شعبهم وهم ساكتون خانعون ينعمون بأموال العراق ! وما صراخ ليث الدليمي إلى بسبب الظلم الذي وقع عليه فكم من ليث في سجون العراق لا يصل صوته لإسماعنا وبعد كل ما تقدم نطالب المنظمات الدولية بالتدخل لإنقاذ المعتقلين ومنهم السيد ليث الدليمي الذي يتعرض ألان لأبشع تعذيب حسب ماوصلتنا من معلومات ونؤكد على إن التحضيرات قائمة على قدم وساق لاعتصام سنطالب به بإطلاق سراح المعتقلين الأبرياء في سجون بغداد وشمال العراق وهذا اضعف الأيمان ...

A tape of his confession was going to be aired in a press conference, when he and his fellow prisoner stood up and said the whole thing is staged and the confessions were extracted under torture.

We strongly deplore the barbaric action of insulting the detainee Laith al-Dulaimi carried out by the Government of the Green Zone, represented by the leadership of the Baghdad police  and his colleagues in the hall of the press conference. We are disgusted to learn that they used torture to extract false confessions for political purposes. These confessions are then used to indict them under the Terrorism act. Regardless of whether Laith al-Dulaimi, is innocent or not, what took place yesterday in the Conference Hall of humiliation and sectarian insults should have been stopped by any decent human being let alone an Iraqi claiming to be honorable and responsible. And if this is how Laith al-Dulaimi,  a member of the Baghdad Provincial Council is treated we fear that the other prisoners who are languishing for years in the prisons of Iraq, from Zakho (near Turkish border) to Fao (the southern most town) fare even worse.

Laith had the opportunity to dare raise his voice to the world to expose the torture affecting him and his fellow prisoners, who would convey the voice of the thousands oppressed and languishing for years in the prisons up and down the country? We in the Popular Movement to save Iraq condemn this barbaric behaviour. It appears that no Iraqi citizen no matter what his/her position is immune from human rights violations and torture  under this repressive and authoritarian government. We wish that the players of this political process would have a ‘small taste’ of  the hell the detainees in the prisons of the government since 2003 have experienced /are experiencing. We wish they would experience first hand, the injustice and grievance experienced by their own people while they are enjoying Iraq’s riches.
We  managed to hear Laith al-Dulaimi ‘s call to stop the injustices, how many Laiths are there in the prisons of Iraq whose voices we do not hear?
We call on international organizations to intervene to save the detainees, including Mr. Laith al-Dulaimi. We received information that Laith is now at the end of worst torture practices since his outburst.
We are preparing for a protest calling for the release of innocent detainees in the prisons of Baghdad and northern Iraq, and ‘that is weakest form of action our religious duty demands’   [this is the least we should do]...

Bad Apple



So it turns out that mass-murder suspect Robert Bales once used a bad word in a Facebook conversation.
This is one of the more bizarre details of his life that has come breathlessly to light in the media, along with his big smile, arrest record and disastrous financial dealings. The word was “hadji” (misspelled “hagi”), which is the racial slur of choice among U.S. troops to denigrate Iraqis; and stories where I have read about his use of it fixate on it judgmentally, as though to suggest it might explain something: the tiny flaw that reveals a propensity for massacring children.
Something had to be wrong with him, right? As always, the mainstream media’s unquestioning assumption is that the atrocity is the work of an individual nut . . . a flawed patriot, a bad apple. Oh so quietly ignored is the possibility that there’s something wrong with the military system and culture that produced him.

وفي ختام بيانها، حملت هيئة علماء المسلمين الاحتلال السافر وحكومته الحالية المسؤولية المباشرة عن هذه الاعتقالات التعسفية التي حولت العراق ـ وبشهادة العالم أجمع ـ إلى سجن كبير ترتكب فيه أبشع الجرائم باسم الحرية والديمقراطية الزائفتين .. مجددة في الوقت نفسه مطالبتها للهيئات الدولية والمنظمات المعنية بحقوق الإنسان ومنظمة التعاون الإسلامي وجامعة الدول العربية، بالتدخل السريع والجاد لوقف هذه الانتهاكات الصارخة وفضح مرتكبيها، والعمل على إطلاق سراح جميع المعتقلين الأبرياء.
The human rights section in the Association of Muslim Scholars (AMSI) published its findings for the month of January 2011, that witnessed (210) raids carried out by various government agencies, and resulted in the arrest (1388) citizens including (5) of women.The HR department of AMSI said in a statement issued by the Association today is that these unjust campaigns affected (14) province, and the Diyala province being at the top of the list for the largest share of arrests; (333) , followed by the province of Nineveh, came in second by (245) prisoners, and Salah al-Din (160 ), capital city of Baghdad (124), Karbala (117) and the province of Babylon (105), and the province of Dhi Qar (103) detainees, then Taamim (Kirkuk) (50) prisoners, and Missan (44), Basra (36), and Anbar (33), and Wasit (26) prisoners, then the province of Muthanna eight detainees, and finally Qadissiya four detainees.
Baring in mind that the new statistics limited to those declared by the Ministries of Interior and Defense in They do not include arrests carried out by the so-called Department of Homeland Security, and the offices of the so-called fight against "terrorism", or those of the Office of the President of the current government, and the statistics does not include arrests carried out by the random forces of the Awakening, and the militias and security forces in the Kurdish provinces of different spade (Diyala, Tamim, Salahuddin and Nineveh, and Sulaymaniyah, Erbil and Dohuk).

America The US isn't leaving Iraq, it's rebranding the occupation

  • For most people in Britain and the US, Iraq is already history. Afghanistan has long since taken the lion's share of media attention, as the death toll of Nato troops rises inexorably. Controversy about Iraq is now almost entirely focused on the original decision to invade: what's happening there in 2010 barely registers.

    That will have been reinforced by Barack Obama's declaration this week that US combat troops are to be withdrawn from Iraq at the end of the month "as promised and on schedule". For much of the British and American press, this was the real thing: headlines hailed the "end" of the war and reported "US troops to leave Iraq".

    Nothing could be further from the truth. The US isn't withdrawing from Iraq at all – it's rebranding the occupation. Just as George Bush's war on terror was retitled "overseas contingency operations" when Obama became president, US "combat operations" will be rebadged from next month as "stability operations".

    But as Major General Stephen Lanza, the US military spokesman in Iraq, told the New York Times: "In practical terms, nothing will change". After this month's withdrawal, there will still be 50,000 US troops in 94 military bases, "advising" and training the Iraqi army, "providing security" and carrying out "counter-terrorism" missions. In US military speak, that covers pretty well everything they might want to do.

    Granted, 50,000 is a major reduction on the numbers in Iraq a year ago. But what Obama once called "the dumb war" goes remorselessly on. In fact, violence has been increasing as the Iraqi political factions remain deadlocked for the fifth month in a row in the Green Zone. More civilians are being killed in Iraq than Afghanistan: 535 last month alone, according to the Iraqi government – the worst figure for two years.

    And even though US troops are rarely seen on the streets, they are still dying at a rate of six a month, their bases regularly shelled by resistance groups, while Iraqi troops and US-backed militias are being killed in far greater numbers and al-Qaida – Bush's gift to Iraq – is back in business across swaths of the country. Although hardly noticed in Britain, there are still 150 British troops in Iraq supporting US forces.

    Meanwhile, the US government isn't just rebranding the occupation, it's also privatising it. There are around 100,000 private contractors working for the occupying forces, of whom more than 11,000 are armed mercenaries, mostly "third country nationals", typically from the developing world. One Peruvian and two Ugandan security contractors were killed in a rocket attack on the Green Zone only a fortnight ago.

    The US now wants to expand their numbers sharply in what Jeremy Scahill, who helped expose the role of the notorious US security firm Blackwater, calls the "coming surge" of contractors in Iraq. Hillary Clinton wants to increase the number of military contractors working for the state department alone from 2,700 to 7,000, to be based in five "enduring presence posts" across Iraq.

    The advantage of an outsourced occupation is clearly that someone other than US soldiers can do the dying to maintain control of Iraq. It also helps get round the commitment, made just before Bush left office, to pull all American troops out by the end of 2011. The other getout, widely expected on all sides, is a new Iraqi request for US troops to stay on – just as soon as a suitable government can be stitched together to make it.

    What is abundantly clear is that the US, whose embassy in Baghdad is now the size of Vatican City, has no intention of letting go of Iraq any time soon. One reason for that can be found in the dozen 20-year contracts to run Iraq's biggest oil fields that were handed out last year to foreign companies, including three of the Anglo-American oil majors that exploited Iraqi oil under British control before 1958.

    The dubious legality of these deals has held back some US companies, but as Greg Muttitt, author of a forthcoming book on the subject, argues, the prize for the US is bigger than the contracts themselves, which put 60% of Iraq's reserves under long-term foreign corporate control. If output can be boosted as sharply as planned, the global oil price could be slashed and the grip of recalcitrant Opec states broken.

    The horrific cost of the war to the Iraqi people, on the other hand, and the continuing fear and misery of daily life make a mockery of claims that the US surge of 2007 "worked" and that Iraq has come good after all.

    It's not only the hundreds of thousands of dead and 4 million refugees. After seven years of US (and British) occupation, tens of thousands are still tortured and imprisoned without trial, health and education has dramatically deteriorated, the position of women has gone horrifically backwards, trade unions are effectively banned, Baghdad is divided by 1,500 checkpoints and blast walls, electricity supplies have all but broken down and people pay with their lives for speaking out.

    Even without the farce of the March elections, the banning and killing of candidates and activists and subsequent political breakdown, to claim – as the Times did today – that "Iraq is a democracy" is grotesque. The Green Zone administration would collapse in short order without the protection of US troops and security contractors. No wonder the speculation among Iraqis and some US officials is of an eventual military takeover.

    The Iraq war has been a historic political and strategic failure for the US. It was unable to impose a military solution, let alone turn the country into a beacon of western values or regional policeman. But by playing the sectarian and ethnic cards, it also prevented the emergence of a national resistance movement and a humiliating Vietnam-style pullout. The signs are it wants to create a new form of outsourced semi-colonial regime to maintain its grip on the country and region. The struggle to regain Iraq's independence has only just begun.

وأتذكر جيدا بان 'الآداب'، كانت المجلة العربية الوحيدة، التي اصدرت اعدادا خاصة عن الادب والثقافة العراقية في سنوات الحصار الجائر الذي شمل حتى الكلمة المطبوعة. وقد اقام احد الشيوعيين الليبراليين الجدد دعوى ضد مجلة 'الآداب'. ولمعرفة فحوى الدعوى، فلنقرأ ما كتبه سماح ادريس، في صحيفة الاخبار، موضحا، بعد ان أصدرت محكمة لبنانية حكما جائرا ضد مجلة الآداب. يقول سماح: 'نشرتُ افتتاحيّتي المذكورة، موضوعَ الدعوى، وعنوانُها 'نقدُ الوعي النقديّ: كردستان ــــ العراق نموذجاً' في العدد 5/6/2007 من مجلة الآداب. والهدفُ الأوّلُ والأخيرُ منها هو نقدُ 'أدعياء الوعي النقديّ' الذين 'يهاجِمون ظالمين مستبدّين، لكنهم يَسْكتون عن ظالمين مستبدّين آخرين' على ما جاء في خاتمة الافتتاحيّة. وكنتُ قد بدأتُها، ضمن هذا الإطار، بنقد الزملاء أدونيس (فردّ عليّ في جريدة 'الحياة'، التي امتنعتْ عن نشر ردّي، فنشرتُه في جريدة 'الأخبار'، وانتهى الأمر)، وشاكر النابلسي، وبول شاوول، وعلي حرب. ثم عرّجتُ على مهرجان المدى الذي أقيم بين 29 نيسان(ابريل) و6 أيّار(مايو) من ذلك العام في كردستان ــــ العراق، برعاية جلال الطالباني وإدارة 'الزميل فخري كريم'، ودُعي إليه 700 أو 800 مثقّف على ما جاء في وسائل الإعلام. فاستغربتُ أن يذهبَ أكثرُ هؤلاء إلى مهرجان المدى في أربيل وأن يلتقوا بجلال الطالباني من دون أن يتحقّقوا من واقع الأمور هناك، من قبيل: دوْر الموساد الإسرائيليّ، وحقوقِ الإنسان (والمرأة)، ودورِ الحزبين الكرديين الرئيسيين في دمار كردستان بسبب اقتتالهما، وهويّةِ الداعي (فخري كريم) السياسيّةِ نفسِها. وأجريتُ بحثاً دقيقاً كشفتُ من خلاله أموراً كثيرةً أهمُّها: وجودُ الموساد في كردستان وجوداً شرعيّاً (وذلك باعتراف رئيس مكتبه السابق أليعازر جيزي تسافرير، وبالاستناد إلى تحقيقيْن صحافيّين لسيمور هيرش ولورا روزن ومقالاتٍ في صحيفتيْ 'يديعوت أحرنوت' و'هآرتس' الإسرائيليتين)، وتزايدُ جرائم الشرف، وتوقيفُ الصحافيين، واستخدامُ التعذيب ضدّ الموقوفين (بحسب تقرير بعثة الأمم المتّحدة لمساعدة العراق في نيسان/أبريل 2007)، وسوءُ معاملة العرب داخل كردستان. وتوقّفتُ أخيراً في مقطعٍ من عشرة سطور (ضمن مقالي المكوَّنِ من 275 سطراً) عند الزميل الناشر فخري كريم، بوصفه الداعيَ إلى هذا المهرجان الضخم، وبوصفه 'كبيرَ مستشاري' الرئيس العراقيّ المدعوم من الاحتلال الأمريكيّ عقب إسقاط نظام صدّام حسين. فاستهجنتُ ألاّ يكترثَ أحدٌ تقريباً من المثقفين والصحافيين المدعوّين (باستثناء حفنةٍ قليلةٍ كالزميل وائل عبد الفتّاح) لعشرات المقالات والبيانات التي تتحدّثُ عن مصير أموال الحزب الشيوعيّ العراقيّ، وأموالِ مجلة النهج ودار المدى، ولا عن صلات بعض 'الشيوعيين العراقيين القدامى/الجدد' باستخبارات النظام السابق فضلاً عن استخبارات أخرى عربيّةٍ وغير عربيّةٍ في ما تلى ذلك من عقود.
وختمتُ الافتتاحيّةَ بالمقطع التالي: 'إنّ وطننا، الوطنَ العربيّ، في مأساةٍ لا لأننا ابتُلينا بأنظمةٍ مستبدّةٍ فحسب، وبأطماعٍ إمبرياليّةٍ وصهيونيّةٍ متعجرفةٍ فقط، بل لأننا أيضاً إزاء تراجعٍ حادٍّ في الوعي النقديّ الحقيقيّ'؛ ذلك أنّ جزءاً من الوعي السائد يتجلبب بالنقديّة المزيّفة لينقدَ (عن صوابٍ) الديكتاتوريّاتِ العربيّةَ المقيتة، لكنه يَصْمت صمتَ القبور عن 'الديمقراطيّة' الأمريكيّة الجديدة التي أوْدت بحياة مئاتِ الآلاف ويتّمتْ أمثالَهم وقَسّمت العراقَ'.
هذا هو ' جرم القدح والذمّ' الذي سيتوجب على الآداب دفع غرامة ستة ملايين ليرة لبنانيّة عنها، فضلا عن مبلغَ مئة ألف ليرة كتعويض رمزيّ للمدّعي فخري كريم وَلي. والكل يعلم ان مجلة الآداب مستقلة تعتمد في ميزانيتها على اشتراكات القراء وليست كمثقفي مستشارية 'صاحب الفخامة الرئيس طالباني'، وهي دائرة تجمع عشرات المهللين لـ 'ديمقراطية العراق الجديد' والمتعامين عن الواقع الاجرامي لها وبميزانية تصل ملايين الدولارات، يعرف الجميع مصدرها وكيفية انفاقها وفي اي البطون تستقر.
وليس سماح أدريس هو الوحيد الذي تم جره الى المحاكم بتهمة كهذه فقد سبقه رفع دعاوى على صحافيين وكتاب عراقيين تجرأوا على ان يكونوا مستقلين وان يكتبوا الحقيقة. حيث حكم عليهم بغرامات مليونية كطريقة ' قانونية' لاغلاق الصحيفة اوالموقع. ويتراوح اسلوب تكميم الافواه الحرة ما بين التعجيز المالي للصحيفة او المجلة او الترويع أو التصفية الجسدية. ولا تخلو تقارير المنظمات الحقوقية الدولية من ذكر اسماء صحافيين وكتاب تم الاعتداء عليهم جسديا واختطافهم واعتقالهم وتعذيبهم فضلا عن القتل ومحاولات الاغتيال سواء في اقليم كردستان او بقية ارجاء العراق، وتحت غطاء واسع من التهم، ولعل اكثرها شيوعا هي تهمة ' التحريض على الارهاب' على خطى السياسة الامريكية في 'الحرب على الارهاب'. وهي حرب ذات مفهوم مطاطي، بامكان امريكا ان تشنها كيفما شاءت واينما شاءت، وفقا لمتطلباتها واستراتيجية امنها القومي، وتستند بدرجة كبيرة الى آلية تلفيق الاحداث وتحويلها الى حقائق ضد 'العدو' أي الدول المارقة والإرهابيين الإسلاميين (بعد تلاشي خطر الشيوعية). وتحت هذا الغطاء الشامل، أصدر الكونغرس الامريكي في كانون الاول 2009، قرارا بمعاقبة القنوات التلفزيونية 'المحرضة ضد امريكا' وتحميل البلدان التي توجد فيها المسؤولية. والقنوات المتهمة هي المنار (حزب الله) والاقصى (حماس) والرافدين (هيئة علماء المسلمين)، أي القنوات التي تنطلق منها اصوات المقاومة الفلسطينية واللبنانية والعراقية ضد الاحتلال الامريكي الصهيوني، وكأن الامر الطبيعي في البلدان المحتلة هو خلوها من المقاومة واستقبال المحتل المغتصب 'بالازهار والحلويات'.
أما الحدث الثاني فيتعلق بمثنى حارث الضاري، مسؤول المكتب الإعلامي لهيئة علماء المسلمين، الذي اصدرت الخزانة الامريكية قرارا باعتباره 'ارهابيا' واضافت اسمه 'الى قائمة الامم المتحدة للمنتمين لتنظيم القاعدة الى جانب الافراد والمنظمات ذات الصلة بحركة طالبان'. ويأتي القرار في ذات الوقت الذي تعمل فيه الادارة الامريكية على تقديم مشروع جديد ينص على معاقبة القنوات العربية التي تستضيف أي شخص ورد اسمه في 'قائمة الارهاب' الامريكية المكونة من 443 صفحة والتي يحتل معظمها 'اسلاميون متطرفون'.
ولن ادخل في نص القرار الخالي من أي دليل لأنه لن يصمد للحظات امام اية مساءلة قضائية وقانونية مستقلة، ولن ادافع عن الضاري كشخصية وطنية مقاومة، الا انني، للنظر في مصداقية الجهة المصدرة للقرار، ساعيد الى الاذهان صورة وزير الخارجية الامريكية السابق كولن باول متحدثا في الامم المتحدة يوم 5 شباط/فبراير 2003 عن اسلحة الدمار الشامل التي يمتلكها ويطورها العراق، المهددة لامن وسلامة العالم، وكيف أدى الخطاب الملفق شكلا ومضمونا الى شن الغزو على العراق وتسبب بتخريب البلد وقتل ما يزيد على المليون مواطن، بمباركة الامم المتحدة. فهل بامكان اي شخص، في العالم، مهما كانت سذاجته ان يصدق الحكومة الامريكية؟ ومن هو الارهابي في هذه الحالة؟
أليست الادارة الامريكية هي التي يجب ان تحاكم ويوضع اسمها في قائمة الارهاب لارتكابها جرائم حرب وابادة، وهناك اطنان من الوثائق والصور والشهادات المثبتة لذلك؟
ان ما تتعرض له مجلة الآداب جزء من سياسة منهجية لقمع الاصوات الناطقة بالحقيقة في شأن ثقافي يمس صميم مفهوم الثقافة ودور المثقف الحقيقي الفكري النقدي. وقد فشلت المحاولة، اذ بدلا من الصمت والاستسلام، اعلن سماح ادريس عن استئناف الحكم وإعادة نشر المقال ـ موضوع الدعوى الجائرة، معلنا 'تشبثه بكل كلمة جاء فيه، وقراره الاستئناف... لا في المحكمة فقط بل في فضح أدعياء اليسار ومبرري الاحتلال ومستشاري السلاطين وأعداء الحرية'.
أما ما يتعرض له مثنى حارث الضاري فهو محاولة لقتل روح المقاومة التي حرص، في مقابلة له مع الجزيرة، على التأكيد بانها 'بكل أنواعها وعلى رأسها المقاومة المسلحة هي أمر مشروع دينيا وقانونيا'، مضيفا بأنهم في اطار القوى الوطنية المناهضة للاحتلال يعملون 'تحت مظلة المادة 51 من ميثاق الأمم المتحدة التي تنص على أن الشعوب لها حق في الدفاع عن نفسها إذا ما احتلت'.

تمكين المرأة العراقية في ورشات الديمقراطية الامريكية

بعيدا عن ملهاة الانتخابات ونتائجها المعروفة لأصحاب القرار الأمريكي، تبقى المرأة العراقية محط اهتمام هؤلاء أيضا ضمن سياسة القوة الناعمة ومكافحة 'التمرد'. وهذا الجانب الناعم هو ما يجري التركيز عليه إعلاميا، في محاولة لتغطية الجرائم والفضائح التي لا نزال نشهد إستمرارها على الرغم من أنسحاب القوات الى قواعدها.
فقد اصدرت السفارة الامريكية في المنطقة الخضراء، ببغداد، بمناسبة يوم المرأة العالمي بيانا صحافيا وجهت فيه وزيرة الخارجية هيلاري كلينتون والمنسقة الامريكية لـ'مبادرات المراة في العراق' باتريشيا هازلاك، رسالتين الى المرأة العراقية. كما قامت وزارة الخارجية الامريكية بترتيب زيارة لاثنتين وعشرين 'قيادية عراقية' لزيارة امريكا. وتخبرنا هيلاري كلينتون، وزيرة الخارجية الامريكية، اثناء استقبالها الوفد النسائي العراقي، بان غرض الزيارة (وهذه ليست نكتة بل نقلا حرفيا لما قالته) هو 'المشاركة في تبادل الأفكار في مجال الخدمة العامة في الولايات المتحدة والعراق'. ولئلا نقلل من قيمة ما تعلمته الادارة الامريكية من 'القياديات العراقيات' لتحسين اداء الخدمات للمواطن الامريكي، ساكتفي بالقول بئس ما تعلمناه من الادارة الامريكية في مجال الخدمات العامة للمواطن العراقي. وقد تمكنت 'القياديات' من حضور ورشات عمل مكثفة للتدريب على النزاهة والشفافية والديمقراطية وحقوق المرأة.
أما رسالتا هيلاري كلينتون وباتريشيا هازلاك، فقد تغنت فيها السيدتان اولا بشجاعة وقوة المرأة العراقية. وهو اسلوب خطابي معروف، يستخدم، غالبا، كخطوة اولى لامتصاص النقمة وتهدئة الطرف الموجه اليه الخطاب ومن ثم تمهيد الطريق لتليين ارادته وجعله متقبلا لما سيليه من تزييف للحقائق. ويكمن زيف المسؤولتين الامريكيتين في تصريحهما بان سبب معاناة المرأة العراقية هو 'الحرب والمصاعب الاقتصادية وتهديد التطرف'. وهنا تكمن جرعة المخدر الثانية الموجهة الى المرأة، حيث يتم التركيز على ذكر العموميات بدون تحديد الجهة المسببة او تحميل جهة ما المسؤولية. وكأن الحرب والمصاعب الاقتصادية تعني بلدا افريقيا يعاني من الفقر والمجاعة والحروب الاهلية. ولم تعد سياسة فرض الحصار الجائر على مدى 13 عاما ومن ثم شن الغزو والاحتلال وتهديم الدولة وتنصيب حكومة وكلاء ينتمي معظمهم الى جاهلية القرون الوسطى، مسؤولية امريكية.
وجاء في رسالة هازلاك (كانت مشرفة على برنامج الاعمار في افغانستان بالمليارات وما ادراك ما برنامج الاعمار!): 'نحن ملتزمون في العراق بالتنمية والازدهار، والمرأة العراقية هي جزء أساسي من هذه المعادلة'. ويبدو ان مفهوم 'التنمية والازدهار' يعني، بالنسبة الى السفيرة هازلاك وامثالها، ان يبقى العراق كما في السنوات السبع الماضية، المرتبة الاعلى بين الحكومات الفاسدة اداريا وماليا في العالم، وان تبقى المرأة العراقية أرملة تبحث عن لقمة العيش لها ولاطفالها.
والمعروف ان المبلغ الذي دخل بطون المتعاقدين يشمل الجزء الأكبر من الـ311 مليار دولار من عائدات النفط العراقي في السبع سنوات، وما يوازيها مما خصصته أمريكا لمشاريع إعمار خاصة من ميزانيتها، ومن تخصيصاتها العسكرية التي يلعب المتعاقدون دورهم المتزايد فيها. ويجدر بنا التأمل في معنى إهدار 20 الف دولار لكل عراقي طفل ورجل وإمراة خلال هذه السنوات، بالمقارنة مع ميزانية العراق في سنوات الحصار.
وتشير هازلاك بفخر الى ان 'الولايات المتحدة في شراكة مع المرأة العراقية بشأن طائفة واسعة من المبادرات، من محو الأمية والرعاية الصحية، لتمويل المشاريع الصغيرة وتطوير الأعمال'. واذا مادفعنا جانبا مفردة 'الشراكة' المزيفة الواردة في الرسالة استغفالا للمتلقي، وتفحصنا بعض 'الطائفة الواسعة من المبادرات' لوجدنا انها لا تزيد عن كونها حفنة من المشاريع الصغيرة الهادفة الى تقديم صورة اعلامية ايجابية عن التحسينات التي ادخلتها الادارة الامريكية بعد خراب البلاد والعباد. حيث يتم اختيار عشر شابات للتدريب على 'القيادة الديمقراطية' مثلا او بضع منظمات مجتمع مدني تعمل على 'نشر الديمقراطية' و'تعليم الخياطة' لعشرين امرأة، او ان تمنح طبيبة واحدة منحة للتدريب في امريكا تقوم خلالها باجراء المقابلات عن تطورها العلمي. وخلال هذا كله، تتحاشى الموفدات ذكر اسباب الخراب الاقتصادية والتعليمية والصحية والمجتمعية. انهن لكي يستمررن بتلقي التدريب والمنح والاعانة وزيارة امريكا كقياديات، يستطعن الشكوى من قلة الخدمات وسوء التعليم والنظام الصحي وحتى الفساد مازال اصبع الاتهام يشير الى العراقيين، وان كانوا وكلاء للمستعمر، ولا يتوجه نحو المستعمر نفسه. عليهن ان يسايرن سياسة المستعمر ولايتجاوزنها.
واذا ما كان تركيز هازلاك وكلينتون على تأمين التعليم والصحة للمرأة كأساس لتمكينها فكلنا يعلم بان من هدم اعدادا كبيرة من المدارس واستخدمها كقواعد عسكرية ومن سرق اموال العراق المخصصة لبناء المدارس والمستشفيات هم متعاقدو الادارة الامريكية والبنتاغون ووكلائهم في العراق، فضلا عن سياسة نشر الامية بشكل منهجي عن طريق قتل الاساتذة والمعلمين وترويع البقية الباقية وارهابهم واجبارهم على مغادرة البلد، فكيف تريد السيدتان 'تمكين المرأة' وهي التي خسرت اكثر من غيرها في مجالات التعليم والصحة منذ الزحف 'المغولقراطي' عليها وعلى بلدها؟
واذا ما نظرنا الى طبيعة الاعمال والمبادرات الصغيرة المتوفرة للمرأة لوجدنا ان معظمها يقتصر على العقود الموقعة من قبل فرق جيش الاحتلال مع 'نساء الاعمال' المتعاونات معه ضمن مبادرات استبدال القوة العسكرية بالقوة الناعمة في مرحلة الاستعمار الجديد. وتبرر المتعاونات مع جيش الاحتلال عملهن بانهن يساهمن في ان تلعب المرأة دورا في 'بناء العراق'، وكأن المراة العراقية كانت جالسة، عبر التاريخ، بانتظار وصول الغزاة المغولقراطيين، لتساهم في بناء بلدها. انهن، بتصريحاتهن هذه، وهي موجودة على اليوتيوب لمن يود مشاهدتها، انما يساهمن لا في بناء العراق كما يتوهمن بل في تبرئة المحتل من جرائم الحرب التي ارتكبها ولا يزال يرتكبها. انهن يقفن الى جانب مجرم حرب مسؤول عن استشهاد مليون عراقي ووجود مليون ارملة. انهن يساهمن في شرعنة وتبرير وجود مجرم حرب يقتل ويغتصب ويعذب.
تقول هيلاري كلينتون في رسالتها الى المرأة العراقية بانها مؤمنة بشعار الامم المتحدة الذي أطلقته في مؤتمر بكين قبل خمسة عشر عاما والذي ينص بوضوح تام على ان حقوق الإنسان هي حقوق المرأة، وحقوق المرأة هي حقوق الإنسان. وهذا موقف انساني رائع نؤيده بقوة ولكن هل حدث ونظرت هيلاري كلينتون وغيرها من نسويات الادارة الامريكية الاستعماريات ووكيلاتهن العراقيات الى واقع المرأة العراقية ليحصين عدد واوجه الانتهاكات التي تعرضت لها منذ الغزو وحتى اليوم؟ هل يدركن بانه ليس هناك اي حق من حقوق الانسان لم ينتهك في العراق في ظل حماية حقوق الانسان الامريكية؟ وكيف سيتعاملن، ولنفترض حسن نية هيلاري كلينتون ومن معها، مع ذوي الشهداء واللواتي هتكت اعراضهن واللواتي يتم تهريبهن للمتاجرة
باجسادهن وما يقارب الخمسة ملايين مهجر؟
وترش كلينتون الملح على جروحنا حين تخبرنا باننا 'قد أحرزنا تقدما كبيرا'. عن اي تقدم تتحدث؟ هل تتحدث عن تفجير البيوت بمن فيها من نساء واطفال كما حدث يوم 5/3/2010 حين قامت قوة حكومية بتفخيخ منزل المواطن علي راضي عودة العبيدي، في ناحية الرشيد جنوب بغداد، وتفجيره على العائلة التي تسكن فيه مما أدى إلى مقتل ثلاثة أطفال ـ وهم بنتان وولد ـ وإصابة والدتهم بجروح خطيرة، حسب موقع الهيئة نت. أو لعل كلينتون تتحدث عن قتل قواتها، يوم 12 آذار/مارس، سبعة مواطنين من عائلة واحدة وإصابة اثنين آخرين بجروح خطيرة 'برصاص عشوائي' خلال مداهمتها لبيت في شمال مدينة العمارة بجنوب العراق؟
أو ربما كانت كلينتون، حامية حق المرأة في الحياة والعمل، تتحدث عن الصحافية الشابة اسيل العبيدي (28 عاما) التي كانت في سيارة اجرة، يوم 11 آذار/مارس، وكانت القوات، كالعادة، تسير بالاتجاه المعاكس للسير مما فاجأ سائق السيارة التي كانت تقل العبيدي وتوقف فجأة، فقامت قوات الاحتلال باطلاق النار على السيارة ما ادى الى اصابة العبيدي برصاصتين الاولى في رأسها والثانية في رقبتها ما أدى الى مقتلها وسائق السيارة على الفور؟ وبطبيعة الحال لم يجر اي تحقيق في الجريمة وعلى الرغم من أنه وبموجب الاتفاقية الامنية الموقعة بين العراق والولايات المتحدة لا يجوز للقوات الامريكية التجوال داخل المدن العراقية الا برفقة القوات العراقية وبناء على طلبها!
وهل نحن بحاجة الى التذكير باستشهاد الصبية عبير الجنابي واغتصابها وحرق جسدها وقتل شقيقتها هديل ووالديها، لنوضح لسياسيي المستعمر، امريكيين كانوا او عراقيين، أناثا كانوا او ذكورا، باننا نعرف جيدا بان صمتهم وعماهم وطرشهم عن جرائم القتل بانواعها، ليس 'عشوائيا'! وأن مشاركة المستعمر في غزوه وتشجيعه، كتابة وتصريحا وفعلا، كما فعل 'البروفسور' كنعان مكية، عندما أخبر الرئيس الامريكي السابق جورج بوش بان العراقيين سيستقبلون الجيش الامريكي بالازهار والحلويات، لم يعد يتحمل التبرير بالسذاجة وقلة الفهم لان مانتج عنه من خراب بشري وعمراني وحضاري واقتصادي، لايمكن الا ان يوصف بانه مشاركة في جريمة ويجب اخضاع مرتكبها للمساءلة القانونية، حتى وان قال صاحب النصيحة انه 'نادم على لو أنني لم أقل ما قلته، ويا ليتني كنت شاعرا بهذه النقمة الموجودة لدى العراقيين ومخاوفهم الحقيقية التي لم أكن أفهمها وفهمتها اليوم'.

Iraq: Chalabi and Lami Also Control the “Independent” Elections Commission

One of the many remarkable aspects of the continuing de-Baathification saga has been the apparent willingness of the Iraqi elections commission (IHEC) to more or less mechanically follow the recommendations of the accountability and justice board and its two leading figures, Ahmad Chalabi and Ali Faysal al-Lami. Nonetheless, until now the IHEC has at least maintained a semblance of formal independence in its decision-making by providing its own "independent" consideration of the advice from the justice and accountability board before implementing it. This was the procedure that was followed for example in the recent exclusion of 511 candidates for the 7 March parliamentary elections.

However, with the release of the minutes from one of the latest meetings of the IHEC, both its independence and the distinction between the elections commission and the accountability and justice board are thrown into question in a serious way. Recently, on top of the ban of 500 plus candidates, the IHEC also moved to cancel the approval of nine political entities. The logic that was followed was apparently that when an entity leader was subject to de-Baathification the entire list should have its approval annulled; however the sole legal justification offered was a reference to an order issued by Paul Bremer in 2004 (CPA order 97) which gave the predecessor of the IHEC the right to basically cancel any political entity it wished to cancel – probably reflecting the absence of more plausible, precise and up-to-date legal justifications for establishing links between entity heads and their electoral lists in terms of de-Baathification. Importantly, when the IHEC first issued its decision, one did get the sense that the elections commission had come up with the idea itself, which would have been the most natural procedure since the CPA order relates to the election law that was in use in 2004 and 2005 and since it is the commission itself that is empowered by the CPA reference. But the newly released minutes reveal that the specific idea of reverting to a sweeping CPA edict in order to ban unwanted political entities came not from the IHEC but directly from the accountability and justice board!

In other words, the accountability and justice board is not merely influencing the IHEC. Rather, at times the board is capable of acting as the guardian of the "independent" commission, thinking on its behalf and supplying the very arguments that are being marshalled to defend its supposedly autonomous position. In this case, the brief summary of the relevant meeting on 18 January reveals in an unambiguous way the origin of the idea to use CPA order 97: "The assembly [of the IHEC] discussed letter 231 from the accountability and justice board dated 18 January, entitled 'ban on participation’ and referring to section five of law number 97 on elections and political parties from 2004, and accordingly decided…" When this was later issued as a decision it looked like something that had been agreed by the IHEC. In reality, it was an accountability and justice board decision in everything but the name.

The shocking part of this is not that the IHEC is politicised; that is an open secret recognised by most Iraqis. The new element is that one particular political bloc – the Iraqi National Alliance – seems capable of pushing through its own view at the expense of others, thereby crushing any idea of a neutralising balance of power in this important body that is incidentally also charged with counting the votes after the 7 March elections. The exact timing of the response to the decision by the appellate court last week is particularly interesting in this respect. Around 5 PM local time on Wedsnesday, the IHEC through its spokesman Khalid al-Shami had essentially set out its argument about the appeals court interfering in the prerogatives of the IHEC. Still at 7:30 PM, Hamdiyya al-Husayni of the IHEC (who is close to the Daawa), seemed to signal acceptance of the decision. But at 9:45 the Iraqi National Alliance issued its condemnation, which was followed later in the evening by a statement by one of its allies in the IHEC, Qasim al-Abbudi, to the effect that the commission had not even received the decision by the appeals court and that the apparent approval by Husayni merely reflected her "personal opinion". Soon thereafter, the Daawa followed suit with its own condemnation, thereby once more effectively succumbing to the Iraqi National Alliance and its goal of having de-Baathification at the top of the political agenda ahead of the elections. The next day, the IHEC asked the supreme federal court for a clarification but this was superseded by a meeting of the "four presidencies".

The discussion about the "independence" of the IHEC is of crucial importance to the next stage in the de-Baathification process for a number of reasons. Firstly, it has to be remembered that the rationale for the protest by the accountability and justice board and the Shiite Islamist parties against the appeals court was that the latter had supposedly "infringed" on the prerogatives of the IHEC by going as far as "permitting" participation instead of dealing with de-Baathification status only. It should now be perfectly clear that the accountability and justice board itself is guilty in this respect, not only of carrying out such infringement but moreover of doing it in a way that clearly serves the political ends of its leaders, who are affiliated with the main Shiite alliance. Secondly, this point will assume renewed importance when the appeals court issues its final decision over the coming two days – this time probably limited to the question of whether individual candidates are subject to de-Baathification or not. Already, there is divergence of opinion as to the consequences of a ruling by the appeals court. On the one hand, Ali al-Lami and others in the accountability and justice board have repeated their view that it is the job of the IHEC to make the final decision, and that the commission does not necessarily need to follow the appeals court ruling to the letter. Expressing the opposite point of view, Iraqiyya representatives say the ruling is binding upon the elections commission.

In view of what has now emerged with respect to the ability of the accountability and justice board to dictate the decisions of the IHEC on some occasions, it becomes more important than ever that the IHEC should follow the recommendation of the appeals court one hundred per cent. If not then the whole Iraqi process would become utterly farcical: What is the point of an appeals institution if the court that was overturned has the power to reinstate its original decision in the end by using its "independent" proxies? Under that kind of scenario, the new democracy in Iraq would become about as interesting and competitive as parliamentary elections are in Syria and Egypt.

انتخابات العراق: فوز العلمانية ضد الطائفية؟

تواصل الإدارة الأميركية الجديدة سياستها في الهيمنة الاستعمارية على العراق، وخاصة بعد توقيع الاتفاقية الأمنية وإطارها العام السياسي والاقتصادي والثقافي، مع اختلاف بسيط يميزها عن الإدارة السابقة. وتتمثل نقطة الاختلاف في أن الإدارة الجديدة ترمي كمية أكبر قليلاً من العظام الباقية من وجبتها الفاخرة في صحون المتعاونين معها من سياسيي الاحتلال المحليين. إذ كرّست ميزانية أكبر لتقديم صورتهم وهم يتلذّذون بمص العظام، بشكل يبدون فيه وكأنهم يتناولون وجبة الطعام الأصلية.وقد بدا الاختلاف، في الأسابيع الأخيرة، في حملة التطبيل والتزمير المركزة من أجهزة الإعلام، على اختلاف جنسياتها، الرامية إلى إعادة تعليب المشاركين في انتخابات مجالس المحافظات وتقديم نتائجهم، باعتبارهم الحل السحري لكل ما عاناه ويعانيه وسيعانيه العراقيون على مدى أجيال مقبلة. حيث قُدّم نوري المالكي، بتغليف جديد باعتباره وطنياً قوياً وموحداً لأبناء الشعب ضد الطائفية! وصارت كلماته، وما أكثر الكلمات المنمقة الزائفة في «العراق الجديد»، مزاراً لحجاج سياسة الإدارة الأميركية. فتجشأ الرجل ألفاظ الديموقراطية المطلوبة، واصفاً الانتخابات بأنها «نصر لكل العراقيين»، و«ستوفر للمواطنين فرص العيش الكريم». ومن النقطة التي توقف عندها المالكي، انطلق آخرون؛ فوصفها أحد الشيوعيين ـــــ الليبراليين الجدد المداومين في قناة «الحرة»، بأنها «خطوة مهمة في بناء الدولة العلمانية بعد فشل الطائفية». وتبعه آخر مزايداً، بالقول: «إنها ثورة العلمانية ضد الطائفية». وإذا ما تركنا جانباً التضليل السياسي والترويجي الدعائي، فسيبقى سؤال مهم لا يريد مغادرتنا وهو: ترى ما هي الأحزاب العلمانية التي ذُكرت أخيراً وستساهم في «بناء الدولة العلمانية»، والفاعلة في مجال «ثورة العلمانية ضد الطائفية»؟هل الحزب الشيوعي من بينها، وهو الذي أثلج سكرتيره العام حميد مجيد موسى قلب بول بريمر بموافقته على تبني نظام الخصخصة، والذي تطوّع بالتنازل عن تاريخ الحزب الشيوعي الفكري والنضالي في محاربة الامبريالية، ليصبح تابعاً وفياً لسياسة المستعمر الأميركي الجديد مقابل مقعد واحد في مجلس الحكم استناداً إلى طائفته؟أين هي الأحزاب العلمانية الجديدة ومن هي؟ هل المعني بالعلمانية هو «القائمة العراقية» التي يترأسها إياد علاوي الذي استحق بجدارة لقب جزار الفلوجة، والمتفاخر دوماً بعمله مع أجهزة الاستخبارات البريطانية والأميركية؟ أم أنه صالح المطلك الذي ارتدى عباءة الوطنية حتى تهرأت وسقطت كلية، يوم هرول لتوقيع اتفاقية العبودية مع المستعمر الأميركي مقابل مكافأته ببضعة مقاعد في مجالس المحافظات؟فهل العمل مع الاستخبارات الأجنبية وتبعية المحتل والمستعمر والتشدق بالوطنية بكرة وأصيلاً، هو مقياس ثورة العلمانية ضد الطائفية؟ ولكن، كما نعلم جيداً، ومنذ عام 2003، فالأحزاب الطائفية نفسها لم تتقاعس يوماً عن القيام بالشيء ذاته، بدءاً من الحزب الإسلامي الطائفي السنّي، والمجلس الإسلامي الأعلى الطائفي الشيعي، والدعوة الطائفي الشيعي؟ فمن أين ستأتي الثورة إذاً؟ وضدّ من بالضبط إذا كان كل المنخرطين في عملية الاحتلال السياسية، من طائفيين وعرقيين وعلمانيين، على الرغم من تمثيليات الاختلاف والتعددية، متوحدين في توسلهم بالاحتلال أن يبقى لحمايتهم من غضب الشعب، ومتوافقين في سرقة المال العام الذي تجاوزت مبالغه المليارات؟وإذا ما علمنا أنّ النتيجة التي وصفت بأنها تدل على «شعبية واسعة للقائمة التي يتزعمها رئيس الوزراء»، كانت بمعدل 13% من نسبة المشاركين الكلية البالغة 51% (على افتراض تصديق النسب ونتائجها ومع توزيع البطانيات وبلوغ سعر الصوت الواحد مئتي دولار عشية الانتخابات)، في جميع المحافظات، وأن المحافظات الشمالية، ومنها كركوك، لم تشارك أساساً في الانتخابات على قاعدة إذا كانت لديك مشاكل في إحدى المحافظات فأجّل الانتخابات، وإذا ما علمنا أن أكثر الجهات فرحاً وسروراً بالانتخابات، ليس الشعب العراقي، المنشغل بالبحث عن لقمة عيشه في بلد يحتل المرتبة الثانية في قائمة الدول الأكثر فساداً في العالم، بل الإدارة الأميركية، بدءاً من الرئيس أوباما، مروراً بجنراله ديفيد بيترايوس، الذي وصف نتائجها بأنها «مصدر سعادة» له، إذا ما أخذنا ذلك كله بنظر الاعتبار، لوجدنا أننا ننقاد نحو تساؤل آخر عن معاني بعض المفردات والمصطلحات وكيفية توظيفها إعلامياً. ولننظر إلى مفردات شعار قائمة المالكي «ائتلاف دولة القانون، تغيير وبناء»، وهو شعار استخدمت فيه مفردات يتعطش إليها الشعب العراقي بمقدار تعطشه للهواء غير الملوث. ولكن كما يدل الواقع، فهو استخدام للشعار تضليلي وكاذب. إذ يشير آخر تقرير أصدرته منظمة «هيومن رايتس ووتش» بتاريخ 15 ديسمبر /كانون الأول 2008، إلى «قصور تطبيق القانون والعدالة في العراق»، إذ لم تتوقف حملات الاعتقال العشوائي...وقال نائب مدير قسم الشرق الأوسط وشمال أفريقيا في المنظمة: «العراقيون الذين يمثلون أمام هذه المحكمة لا يسعهم توقع الإنصاف». ويوثق التقرير استناد المحكمة إلى أدلة مستقاة من مخبرين سريين واعترافات قد تكون مُنتزعة بالإكراه. وتبين من الشهادات في المحكمة ومن المقابلات أن الإساءات رهن الاحتجاز، التي تتكرّر كثيراً بقصد انتزاع الاعترافات، هي ممارسة منتشرة. ويوثق التقرير قضايا احتُجز المدعى عليهم فيها لمدة بلغت عامين دون عقد جلسات تحقيق أو محاكمة. ولدى عقد المحاكمة، كان الدفاع في العادة لا يطّلع على المحتجزين وملفات قضاياهم بما يكفي أو لا يطّلع عليها بالمرة قبيل الجلسات، مما يجعل المحامي عاجزاً عن الدفاع. ودعت المنظمة «الحكومة العراقية إلى اتخاذ خطوات فورية من أجل منع الأخذ بالاعترافات وغيرها من الأدلة المنتزعة بالتعذيب، وغير ذلك من الأساليب غير القانونية، وأن تدين علناً أي استخدام للتعذيب أثناء الاحتجاز على ذمة المحاكمة». فما الذي فعله رجل دولة القانون والتغيير للحد من هذه الكوارث، ومع تزايد إصدار أحكام الإعدام بلا مبرر وتنفيذها في ظروف لخص بعضها التقرير؟أولى خطوات التغيير، كانت الإعلان عن بناء 4 سجون جديدة في مختلف أنحاء العراق. وكانت الخطوة الثانية إعلان نائب وزير العدل يوم 24 يناير /كانون الثاني عن إعادة فتح سجن أبو غريب لاستيعاب تزايد السجناء بعد تغيير اسمه إلى سجن بغداد المركزي، باعتبار أن الاسم السابق «يثير ذكريات سيئة لدى العراقيين». مما يعني، حسب منطق المالكي في التغيير، أن المقبرة ستصبح بستاناً إذا ما غُيّر اسمها. وهي مبادرة تُحسب لقوات الاحتلال التي فتحت قرب معتقل «كروبر» في بغداد، معتقلاً أطلقت عليه اسم «دار الحكمة» لاستيعاب 600 طفل معتقل بتهمة الإرهاب تتراوح أعمارهم بين سن العاشرة إلى السادسة عشرة.ولن نستغرب إذا ما غيّر المستعمر أسماء معتقلات بوكا في البصرة وكروبر قرب بغداد وسوسة في السليمانية بأسماء مثل مراكز التأهيل وورشات التدريب على الديموقراطية. أما معتقل الكاظمية للنساء الذي يغتصب فيه جلادو الاحتلال النساء، حسب بعثة الأمم المتحدة لمساعدة العراق، وهي حالات أكدتها بصراحة وزيرة شؤون المرأة قبل أن تستقيل أخيراً، فربما سيسمّونه ورشة تدريب النساء القياديات.ومن يدري فقد يكون هذا هو كل المطلوب لتحقيق مقولات «الثورة والتغيير وبناء الدولة العلمانية» في عراق ما بعد انتخابات مجالس المحافظات، حيث كل شيء مسموح ما دام لا يمس المستعمر وأمن قواته.قد نكون بحاجة للتذكير دائماً بأن المقاومة وطرد المحتل بالقوة هما الباب الوحيد الذي يمكن أن يدخل العراق منه إلى بناء الدولة الوطنية وسيادة القانون والتخلص من الطائفية، وأن ما عدا ذلك أوهام يغذيها الاحتلال وينجرّ إليها بين الحين والآخر بعض الناس

Watchdog Decries Suits Against Journalists

JFO: Libel Charge Silences Iraqi Media; President, Minister Asked to Drop Cases

Iraqi journalists are targeted with libel suits intended to punish them for independent and critical reporting, the Iraqi media watchdog Journalistic Freedoms Observatory (JFO) writes in its recent statement.
Two such cases concern prominent political figures, the JFO alleges. Libel suits are underway in the name of the Iraqi presidency and in the name of the minister of electricity, both of which the JFO demands be dropped.

Iraqi Journalists and Their Institutions Suffer from Lawsuits Raised against Them
JFO Demands That President Talibani Abandon Case against Local Paper
Iraqi journalists and their media institutions in Iraq are exposed to libel suits resulting from their criticism of the performance of some government institutions. 17 such suits were filed against a number of journalists and their institutions on the part of government and security officials. The files of four of the cases are closed, and the rest are still waiting for rulings in the Iraqi courts.
Among these cases is the suit brought by the minister of electricity, Wahid Karim, against the newspaper al-Mada. The suit asks that the paper’s editor in chief pay damages of 20 million Iraqi dinars, as compensation for the effect of damages to his “reputation,” because of what one of the editors of al-Mada wrote based on the remark that “It is hopeless to deal with the problems of electricity,” which was attributed to the minister and published other newspapers.
Al-Mada said that it seems logical to be surprised by this (remark), and to wonder: Is the reputation of the minister harmed more because of the article on an inside page (of the newspaper) in which the editor discusses the claim of hopelessness in addressing the plight of the citizens, or is it damaged more by (the lawsuit) that harms the minister’s reputation, the reputation of the state, and the reputation of Iraq?
While we are talking about surprises, the paper added, we may be surprised to learn that the minister did not know originally that there was a suit raised in his name against al-Mada, seeking compensation of 20 million dinars (approximately 16 thousand dollars) for the damages that affected his reputation.
The Journalistic Freedoms Observatory (JFO) sees in this case an attempt to silence the voices of the free press by pressuring and intimidating it to be wary of what (journalists) publish, or will publish, in all accuracy and credibility.
The Journalistic Freedoms Observatory demands that the minister of electricity respect the freedom to express opinions, and that he accept the professional criticisms of the press, which represents a place where the Iraqi citizen can air his views, and that he distance himself from the pressures that threaten to push the institutions of the press into paying compensation, or threaten to convict the writer of an article or investigative report. JFO demands that the minister safeguard democracy and freedom of expression, and the right of the citizen to obtain information, a sacred right that cannot be abandoned, as journalists are still paying with their lives to preserve their rights and the rights of the Iraqi citizen.
Earlier, al-Mada won a court case that was brought against it last year on the part of the Independent Elections Commission after the newspaper revealed administrative corruption in the commission, and which was considered at the time a victory for the press. The newspaper throughout its reporting was able to reveal corruption and embezzlement of funds on the part of some officials to the courts.
Among the suits that the courts ruled on, with negative results, were the sentencing of our colleague Kamal al-Sayyid Qadir to a 30-year sentence by the court in the city of Irbil last year, on the basis of his criticisms of a number of officials in the regional government, mostly around issues of corruption and nepotism. (The sentence) was lifted after the president of the Iraqi Kurdistan region, Masoud al-Barzani, issued a pardon, which granted his release.

Whereas JFO is still waiting for the Iraqi President Jalal al-Talibani to order the cessation of a suit filed by his office against our colleague Narmin al-Mufti, the editor in chief of the newspaper al-Qal'a.
The suit was brought against the al-Qal'a after it published, in its 34th edition, details on the salaries of workers in the presidency of the republic, which the presidency hastened to deny in a response distributed to the media. Al-Qal'a published the text of this response and the denials, and the editorial committee of the newspaper, under al-Mufti’s supervision opened an investigation with her correspondent who had reported the story. According to what the editor in chief of al-Qal'a said to the JFO, after the determination that the correspondent Salim Hamid Fa’iq had not adhered to the integrity and ethics of the profession, causing embarrassment to the newspaper with the presidency of the republic, the correspondent was dismissed from his work by an official written notice bearing the signature of the editor in chief of the newspaper.
As such, the JFO hopes that the president of the republic, Jalal al-Talibani will drop the legal suit against al-Qal'a, after its commitment to the ethics of the profession and its decisions to prevent any professional failings.

Journalists Face Repression on All Sides

Since the U.S. invasion in March 2003, at least 204 journalists have been killed in the country, a figure that surpasses the media death toll in any other war zone in history, IFJ reports."It is wrong to be complacent about the media situation (in Iraq)," Aiden White, the secretary general of IFJ, told IPS on the sidelines of a May 10-11 safety strategy conference in Arbil that was organized by IFJ and two affiliated Iraqi and Kurdistan journalists' syndicates."The first concern is, of course, the physical safety of journalists," he said. "But the discussion that follows is creating the right environment for journalists in terms of eliminating legal and political pressures."The IFJ, which represents some 500,000 members in more than 100 countries, has complained to U.S. authorities in Iraq about their failure to provide protection for journalists, with few results."We are having a very difficult dialogue with the Americans in Iraq with the way they have handled media," White said. He added that so far, 19 of the journalists killed were found to have U.S.-made bullets in their bodies, "but no satisfactory explanation" has been offered as to the circumstances in which they were shot.

IRAQ:Where Nobody Is Accountable

BAGHDAD, May 21 (IPS) - Killings, crime, lack of medical care, collapse of educationàthe list goes on. But with the occupation by U.S.-led forces now into a fifth year, and a supposedly democratic government in place, no one knows who to hold accountable for all that is going wrong. It is the occupation forces, particularly the United States and Britain, that must be held accountable, many Iraqis say.

"It is good of these people to discuss accountability for theft, but the most important thing to account for is Iraqi blood," Numan Ahmed, a human rights activist from the Adhamiya neighbourhood in Baghdad told IPS.

The British medical journal Lancet has reported that by July 2006, 655,000 people had died as "a consequence of the war." It has reported that the risk of death among civilians is now 58 times higher than before the U.S.-led invasion in March 2003.

"By now a million Iraqis have been killed for no reason, and many millions disabled or badly injured just because of some thieves in Baghdad and Washington," Ahmed said. "We are prepared to reveal the documents to condemn them even if takes us a lifetime."

But Iraqis have no means to take action against occupiers.

The United States has not accepted jurisdiction of the International Criminal Court, which has the power to investigate complaints of genocide. The United States took the view that the court could conduct "politically motivated investigations and prosecutions of U.S. military and political officials and personnel."

U.S. opposition to the ICC is in stark contrast to the strong support for the Court by most of its closest allies. But Iraqis have found no way to proceed against these either.

With no doors of justice open to them, many Iraqis are now taking to unlawful ways to hit back at occupation forces and government targets. "

The only way to do it is at gunpoint," 32-year-old Ali Aziz from Ramadi, 100 km west of Baghdad, told IPS. "They invaded us at gunpoint and we find it ridiculous to talk about any other way of getting back what belongs to us."

Aziz said he had lost several friends in attacks by U.S. soldiers. "The whole world is dealing with this in a hypocritical way, and there is only us to claim our rights the way we find proper."

The human rights group al-Raya filed a case in a local court in Fallujah against U.S. forces in 2004, following a massive military crackdown. About three-quarters of all buildings in the city were destroyed or heavily damaged during the U.S. assault in November 2004.

But U.S.-backed Iraqi security forces have hit out at the human rights group. "The secretary-general for the organisation has now been arrested by Fallujah police for reasons that we are not aware of, and the organisation is not functioning any more," a member of the board, speaking on condition of anonymity, told IPS in Baghdad. "

It is not the right time to talk about accountability when daily killings by U.S. and Iraqi soldiers are still ongoing. God knows if it will ever be possible."

A case for accountability could well be made. A judge from the United States wrote at the time of the trial of Nazi war criminals in Nuremberg in Germany in 1946: "To initiate a war of aggressionàis not only an international crime; it is the supreme international crime differing only from other war crimes in that it contains within itself the accumulated evil of the whole."

The U.S.-led invasion of Iraq was judged by former UN Secretary-General Kofi Annan Sep. 16, 2004 as "an illegal act that contravened the UN charter."

The lack of accountability appears now to be leading to greater support for armed resistance against occupation forces. "What accountability are you talking about, sir," said Abu Jassim from Fallujah, who lost four members of his family when a U.S. bomb destroyed his home during the first U.S. offensive in the city in April 2004. "Americans are criminals, and the whole world is covering up for their crimes." They will be held accountable, he said, by "Allah" and by "the heroes of the Iraqi resistance."

Iraqis are also angry over destruction of their civilian infrastructure, for which no one has been held responsible. "The U.S. crime of deliberately crushing Iraqi infrastructure must be looked at as a crime against humanity," chief engineer Jalal Abdulla at Baghdad's Ministry of Electricity told IPS. "They did not have to do this to support their military effort, but they did it just to cause hundreds of thousands of deaths for no reason but cruelty."

Others vent their frustration against what they see as an impotent United Nations. "The UN should be the place for asking those Americans why they committed so many crimes in Iraq," said Baghdad resident Malik Hammad.

Halt All Executions! Abolish The Death Penalty!

We women of Tadhamun condemn the persisting practice of arbitrary arrests by the Iraqi security forces. We condemn their arrests of women in lieu of their men folk. These are 'inherited' practices. We are alarmed by credible media reports of the Green Zone government’s intentions of executing hundreds of Iraqi men and women.

Building of 1 500 massive police station !
From the angle of the photo, it is possible to calculate that the complex is being built at E 396388 N 3785995 (UTM Zone 38 North) or Lat. 34.209760° Long. 43.875325°, to the west of the Malwiya (Spiral Minaret), and behind the Spiral Cafe.
While the point itself may not have more than Abbasid houses under the ground, it is adjacent to the palace of Sur Isa, the remains of which can be seen in the photo. While the initial construction might or might not touch the palace, accompanying activities will certainly spread over it.Sur Isa can be identified with the palace of al-Burj, built by the
Abbasid Caliph al-Mutawakkil, probably in 852-3 (Northedge, Historical Topography of Samarra, pp 125-127, 240). The palace is said to have cost 33 million dirhams, and was luxurious. Details are given by al-Shabushti, Kitab al-Diyarat.
Samarra was declared a World Heritage site by UNESCO at the end of June. The barracks could easily have been built elsewhere, off the archaeological site.--
