The Long Road to The Hague – prosecuting Blair pt2

August 22, 2010 Regime Change There are few legal justifications for waging war. Where individual states are concerned, every state has the right to self defence (Article 51, UN Charter), but one must prove an attack on one’s territory has taken place (a breach of the state’s sovereignty) or that an attack is genuinely imminent. The only other legal military action is that properly authorised by the Security Council, whether for peace-keeping, intervention or to enforce international law. People want to see Blair tried for war crimes, crimes against humanity and the supreme crime, the crime of aggression. But another crime was committed when we invaded Iraq and, more importantly, which has now been confirmed by papers released since the invasion and by evidence from the Iraq Inquiry. The crime that Blair committed knowingly, deliberately and because, in his own words "I believe I was right" is regime change. There is no basis in international law for regime change. So found a Dutch legal inquiry into the Dutch government’s decision to back the invasion of Iraq. So, said Sir William Patey to the Iraq Inquiry, senior British officials advised when they looked at a proposal for regime change in Iraq in late 2001. A Downing Street memo in March 2002 says: "A legal justification for invasion would be needed. Subject to Law Officers advice, none currently exists…regime change by military means… would require the construction of a coalition and a legal justification… A full opinion should be sought from the Law Officers if the above options are developed further… Of itself, REGIME CHANGE has no basis in international law." It also, tellingly, has this to say: "In the judgement of the JIC there is no recent evidence of Iraq complicity with international terrorism. There is therefore no justification for action against Iraq based on action in self-defence (Article 51) to combat imminent threats of terrorism..." A paper produced by the Cabinet Office in July 2002, discussing the military aspects of invading Iraq, recognises both the US aim of regime change, and the need for lawful justification. To quote: "US views of international law vary from that of the UK and the international community. Regime change per se is not a proper basis for military action under international law". And in her evidence to the Iraq Inquiry, Elizabeth Wilmshurst revealed that not a single legal adviser within the Foreign Office believed the war to be legal. All the advice being given to Blair from 2001 onwards was that invasion for the purpose of regime change was unlawful. And here lies the reason for the 'dodgy dossier’, for Blair’s insistence on Saddam’s weapons of mass destruction, the infamous ’45 minutes’, for the legal opinion on an A4 sheet of paper and the 'real and present threat’ he convinced Parliament this country was facing from Iraq. That the whole thing was an inflated tissue of lies built on very doubtful intelligence did not matter to him. That he stood up in the House of Commons and lied to Parliament did not matter, although that in itself was a serious offence deserving of punishment. What mattered was that it was necessary to prove that Britain was under threat of imminent attack. Failing a UN resolution authorising force, only this would make his drive to war legitimate. And he was committed to going to war. Bush and his team cared little for legality, world opinion or that of their own citizens. But Britain on the whole is a law-abiding country, and Parliament would only back Blair if they could be convinced the invasion would be legal. Now that we have so much more testimony and paper evidence of Blair’s knowledge of the lack of evidence for WMD, for his dismissal of all the legal advice he was being given on the issue of invading Iraq, for his early commitment to regime change knowing full well it would be illegal, and for the lies he repeatedly told the country and Parliament in his bid to persuade us to back his eagerness for war, where do we start? This breach of international law is considered part of the crime of aggression (1) by the ICC, but as we have seen, the invasion of Iraq will not be covered, having taken place before the crime of aggression becomes prosecutable. What should we prosecute him for, now that we know we cannot pursue this route? Regime change was considered illegal in international law, regardless of the ICC, and the only other international option is the ICJ, which 'settles disputes between states’. The only state that could justifiably go to the ICJ with this would be Iraq itself (it’s always a good idea to install a friendly government in the country you have invaded and occupied. It avoids problems like this). Many hold that Iraq’s current government is illegal, and one could perhaps find enough surviving members of the pre-invasion government (illegally overthrown) to take a dispute to The Hague. But one would still have to cope with the Security Council’s vetoes. However, a recognised body could possibly initiate something by seeking an advisory opinion/ruling on Blair vis á vis regime change – a route worth exploring perhaps, but it would be a long and difficult route, with no real result at the end. Prosecuting Blair in Britain On the domestic front, and he is after all a British problem, could he be prosecuted for committing our Armed Forces to effecting an illegal regime change, or indeed any of the other illegal acts they committed during the invasion and occupation of Iraq? Yes, each serviceman or woman should be held responsible for their individual acts, but Blair was at the head of the chain of command, and carries the ultimate responsibility. Could we seriously try for a private prosecution? What are our options? We could still go for war crimes and crimes against humanity, as covered by the ICC Act 2001. John Pilger suggests using the Proceeds of Crime Act. As Felicity Arbuthnot demonstrates, Blair has accumulated millions out of the contacts he made from his decision to invade Iraq. Another possibility, considering his lies to Parliament, his manipulation of and misrepresentation of the intelligence he was given, the financial deals he has set up and his fight to keep those secret despite regulations, would be his abuse of office. A private prosecution would bypass the CPS, but may have to be done quickly as one needs a universal jurisdiction arrest warrant. To quote another government source: "The Government has, after careful consideration, decided that it would be appropriate to require the consent of the Director of Public Prosecutions before a universal jurisdiction arrest warrant can be issued to a private prosecutor. A suitable legislative amendment will be brought before Parliament at the first opportunity." They say they want to avoid people using this action to make political statements or cause embarrassment, but they need to be reminded that nothing should hinder any individual or group from seeking justice. Sheer expense will make people think carefully before taking such an action, and there are many better ways to cause embarrassment. And as with seeking an advisory opinion from the ICJ, it would be best to build a coalition of responsible and serious British organisations and citizens, rather than relying on an individual or a campaigning organisation. A coalition would be far more likely to obtain a universal jurisdiction arrest warrant, should we need the consent of the Director of Public Prosecutions. One could find however, that any private prosecution that gets to court would face government QCs as well as the best lawyers Blair’s money and influence can buy. This takes serious money. Given the possibility of getting Blair into a British or any other court, there would be a queue of international lawyers offering their services for free. But, and this is an essential 'but’, funds must be available to cover the costs of the other side should one lose. Put all the peace campaigners and our cash-strapped organisations together, and we would still not have the money to go up against Blair’s millions. The only answer to that is to engage the backing of some seriously rich people who are committed to peace and law. One thing I am sure of – if it was clear that somebody pursuing a private prosecution did have the financial resources to cover the other side’s costs, then it would be very likely that the party (aka Blair) being prosecuted would attempt, quite desperately, to settle out of court - which, in the interests of law and creating a precedent, would have to be, absolutely must be refused. And there is one further thing to consider – the small but constant drip of courts, juries and judges upholding the law in the face of strong government or corporate opposition. Juries failed to agree, resulting in the judge having to find the Fairford Five not guilty for damaging USAF equipment at Fairford airbase; judges ruled on publishing previously hidden documents, as in the Binyam Mohammed case; they ruled in favour of CAAT and the Corner House over BAE Systems corruption and bribery; the European Court of Human Rights ruled against the UK government following the 'McLibel’ case; and most recently, a judge found SmashEDO activists in Brighton not guilty for 'decommissioning’ EDO’s factory which supplies Israel. We have to remind ourselves that, although we are fighting against 'the system’, many people within that system feel as we do, and are as committed to law and the truth as we are. We have to keep going because sometimes the system is on our side. In 2003-4 people’s anger over the illegality of the invasion ran hot. That anger has not gone away. It has become a cold analytical anger that still seeks justice, justice for the Iraqis and their ruined country; justice for the dead and injured soldiers and their families; justice too, for the damage done to our own country, our civil liberties and our so-called democracy. Until Blair is made fully accountable for his actions we are not free from this shame. That is why, in this morass of law and politics, we must go on searching for a way that furthers, endorses and upholds both international and domestic law, and we start by getting Tony Blair into court. حتمية الخروج الأمريكي وتعويض العراق...؟
إن الوسائل التدميرية والقهرية والقسرية من تهجير وتقطيع لأوصال الوطن الواحد وسحق هرمه الأجتماعي والقيمي قد تجاوزت سوح العمليات العسكرية للقوات الأمريكية حيث طالت المدنيين الأبرياء من دون رادع أخلاقي أو قضائي.. لقد بات من الصعوبة بمكان تقدير وتقييم الكلفة الكلية لتداعيات الأحتلال نظرا لأستمرار عناصر التدمير وتراكم الكوارث بشكل متعاضم إلى جانب غياب الأرادة والقدرة وإنعدام الرغبة الحقيقية والألتزام الأخلاقي والوطني لدى رجالات الحكومة في مطالبة المحتل بإيقاف التدمير وخروج قوات المحتل ودفع التعويضات المشروعة للعراق. في مجال التعويضات على النخب العراقية ذات الخبرة في الجانب العسكري والأمني والأقتصادي والمالي والصحي والأنساني ومن له علاقة بعمل منظمات المجتمع المدني متابعة ومراقبة وحصر النتائج التخريبية التي تحدثها منظومات المحتل ورجاله في البنى التحتية والأقتصاد وممتلكات الدولة والأفراد وأرواح العسكريين والمدنيين وفي عوائل الشهداء والأطفال والشيوخ والمعوقين والسجناء والمنفيّين من النازحين واللاجئين في دول العالم . إن توثيق نتائج الكوارث المباشرة وغير المباشرة تشكل القاعدة المعلوماتية الأولية التي ستساعد الحكومة الوطنية القادمة ،في وضع آليات من أجل إستكمال الحقائق والمطالبة بالتعويض وفق أحكام القانون الدولي التي لم تحترم من قبل الأدارة الأمريكية في الغزو والأحتلال والتدميروالأستعمار والأستعباد ونهب الثروات الوطنية للعراق. إن عمليّتي الأحتساب والتقديرللتعويضات الواجب دفعها من قبل الأدارة الأمريكية الأمريكية يجب أن تتضمن الكلف الأستبدالية والتعويضية : للأجهزة والمعدات العسكرية ،البنى التحتية ،التكاليف الأقتصادية الكلية والجزئية ،خسائرتعطيل الحياة الأقتصادية طيلة فترة الأحتلال والفوضى،الدخول والعوائد والموارد التي غيّبها الأحتلال وحال دون تحققها،إعادة الأعمار والبناء وتفعيل الأقتصاد العراقي،تعويض العسكريين والمدنيين وإرجاع ما نهب وسرق من العراق،مستلزمات الرعايه الصحية للمعوقين والتعويض عن التكاليف الأنسانية التي لايجري في العادة إحتسابها من قبل السياسيين والعسكرين أثناء وبعد الحرب كالتكاليف الصحية والأجتماعية المستقبليه التي يجب دفعها لضحايا الغزو والأحتلال من جرحى ومعوّقين ومرضى يعانون من أمراض عصبية ونفسية مزمنة ، تعويض السجناء الأبرياء والمغتصبين داخل وخارج السجون ، التكاليف المترتبة للأموات والمفقودين والأرامل والمطلقين وممن فقدوا النظر والسمع والكرامة الأنسانية . إن تحقق كامل التعويض سوف لن يسد القيمة الأنسانية والحضارية التي خسرها الأنسان والوطن من جراء الغزو والأحتلال وإنتهاك السيادة والأعراض.
إن المسؤولية الدولية في إعادة إعمار وبناء العراق تقع على عاتق الولايات المتحدة الأمريكية والدول التي شجعت وتآمرت وساهمت وعاونت في الغزو والأحتلال. إن " الحكّام الطلقاء " مّمن أجازوا إستباحة عروبة العراق وسكتوا عن هتك سيادته وقتل أبناءه وإغتصاب نساءه فينتظرهم ليل بهيم ترهقهم فيه ذلّة ووقوف عسير . اللهم إغفر لقومي فإنهم لايفقهون ما يعملون..!!
لقد أثبتت تجارب الشعوب بأن المحتل وحكوماته لايتمتعون بأية أهلية تستوجب الثقة والأحترام. وإن أي حكومة ينصّبها المحتل مصيرها الدمار بعد خروجه . وأن ما يوجده المحتل على الأرض سيزول بخروجه. وأن الستراتيجية الصحيحة لأخراج المحتل هي بجعل تكاليف بقائه عالية جدا وعلى كافة الأصعدة.
إن خروج المحتل الأمريكي تحتمه حقيقة التدهور المستمر في قدراته وبعده عن أرضه. بينما معين الشعب والمقاومة الوطنية العراقية مصادر داخلية لاتنضب ولن تنضب.وأن شعبنا لن يتنازل عن كامل التعويض ولو بعد حين .

US issues threat to Iraq's $50bn foreign reserves in military deal

The US is holding hostage some $50bn (£25bn) of Iraq's money in the Federal Reserve Bank of New York to pressure the Iraqi government into signing an agreement seen by many Iraqis as prolonging the US occupation indefinitely, according to information leaked to The Independent.
US negotiators are using the existence of $20bn in outstanding court judgments against Iraq in the US, to pressure their Iraqi counterparts into accepting the terms of the military deal, details of which were reported for the first time in this newspaper yesterday.
Iraq's foreign reserves are currently protected by a presidential order giving them immunity from judicial attachment but the US side in the talks has suggested that if the UN mandate, under which the money is held, lapses and is not replaced by the new agreement, then Iraq's funds would lose this immunity. The cost to Iraq of this happening would be the immediate loss of $20bn. The US is able to threaten Iraq with the loss of 40 per cent of its foreign exchange reserves because Iraq's independence is still limited by the legacy of UN sanctions and restrictions imposed on Iraq since Saddam Hussein invaded Kuwait in the 1990s. This means that Iraq is still considered a threat to international security and stability under Chapter Seven of the UN charter. The US negotiators say the price of Iraq escaping Chapter Seven is to sign up to a new "strategic alliance" with the United States.
The threat by the American side underlines the personal commitment of President George Bush to pushing the new pact through by 31 July. Although it is in reality a treaty between Iraq and the US, Mr Bush is describing it as an alliance so he does not have to submit it for approval to the US Senate.
Iraqi critics of the agreement say that it means Iraq will be a client state in which the US will keep more than 50 military bases. American forces will be able to carry out arrests of Iraqi citizens and conduct military campaigns without consultation with the Iraqi government. American soldiers and contractors will enjoy legal immunity.
The US had previously denied it wanted permanent bases in Iraq, but American negotiators argue that so long as there is an Iraqi perimeter fence, even if it is manned by only one Iraqi soldier, around a US installation, then Iraq and not the US is in charge.
The US has security agreements with many countries, but none are occupied by 151,000 US soldiers as is Iraq. The US is not even willing to tell the government in Baghdad what American forces are entering or leaving Iraq, apparently because it fears the government will inform the Iranians, said an Iraqi source.
The fact that Iraq's financial reserves, increasing rapidly because of the high price of oil, continue to be held in the Federal Reserve Bank of New York is another legacy of international sanctions against Saddam Hussein. Under the UN mandate, oil revenues must be placed in the Development Fund for Iraq which is in the bank.
The funds are under the control of the Iraqi government, though the US Treasury has strong influence on the form in which the reserves are held.
Iraqi officials say that, last year, they wanted to diversify their holdings out of the dollar, as it depreciated, into other assets, such as the euro, more likely to hold their value. This was vetoed by the US Treasury because American officials feared it would show lack of confidence in the dollar.
Iraqi officials say the consequence of the American action was to lose Iraq the equivalent of $5bn. Given intense American pressure on a weak Iraqi government very dependent on US support, it is still probable that the agreement will go through with only cosmetic changes. Grand Ayatollah Ali al-Sistani, the immensely influential Shia cleric, could prevent the pact by issuing a fatwa against it but has so far failed to do so.
The Grand Ayatollah met Abdul Aziz al-Hakim, the leader of the Islamic Supreme Council of Iraq (ISCI), which is the main supporter of the Iraqi government, earlier this week and did not condemn the agreement or call for a referendum. He said, according to Mr Hakim, that it must guarantee Iraqi national sovereignty, be transparent, command a national consensus and be approved by the Iraqi parliament. Critics of the deal fear that the government will sign the agreement, and parliament approve it, in return for marginal concessions.
لندن- العرب اونلاين- وكالات: ذكرت صحيفة الإندبندانت البريطانية الصادرة الجمعة أن الولايات المتحدة تحتجز نحو 50 مليار دولار "25 مليار جنيه إسترليني" فى مصرفها المركزى بنيويورك للضغط على الحكومة العراقية من أجل اجبارها على توقيع اتفاقية أمنية يرى الكثير من العراقيين أنها ستمدد الإحتلال الأمريكى لبلادهم إلى فترة غير محددة.وقالت الصحيفة نقلاً عن معلومات مسرّبة إن المفاوضين الأمريكيين "يستخدمون وجود 20 مليار دولار مجمّدة بموجب أحكام قضائية ضد العراق فى الولايات المتحدة للضغط على العراقيين من أجل القبول بشروط الاتفاقية الأمنية والعسكرية الجديدة".واوضحت أن الإحتياطيات المالية العراقية فى الخارج محمية بأمر رئاسى أمريكى يمنحها الحصانة ضد الملاحقة القضائية، غير أن الجانب الأمريكى اقترح أنه فى حال انتهاء العمل بتفويض الأمم المتحدة الذى تُحتجز الأموال العراقية بموجبه دون استبداله باتفاق جديد فإن الأموال العراقية ستفقد هذه الحصانة ويخسر العراق 20 مليار دولار.واضافت الصحيفة أن الولايات المتحدة "قادرة على تهديد العراق بخسارة ما يصل إلى 40بالمائة من احتياطياته من العملات الأجنبية لأن استقلاله ما زال مقيداً بعقوبات الأمم المتحدة والقيود المفروضة عليه منذ عام 1990، ما يعنى أن العراق لا يزال يُعتبر تهديداً على الأمن والإستقرار الدوليين بموجب البند السابع من ميثاق الأمم المتحدة".ولفتت إلى أن المفاوضين الأمريكيين "يرون أن ثمن افلات العراق من البند السابع هو التوقيع على ما يعتبرونه تحالفاً إستراتيجياً جديداً مع الولايات المتحدة"، مشيرة إلى أن تهديد الجانب الأمريكى "يؤكد الإلتزام الشخصى للرئيس جورج بوش فى الدفع باتجاه التوقيع فى موعد أقصاه الحادى والثلاثين من يوليو/تموز المقبل على المعاهدة الجديدة والتى يصفها بأنها تحالف كى يتجنب تقديمها إلى مجلس الشيوخ للمصادقة عليها رغم أنها تُعد فى الواقع اتفاقية بين الولايات المتحدة والعراق".وقالت الإندبندانت إن العراقيين المنتقدين للإتفاقية يرون أنها ستجعل العراق "دولة تابعة للولايات المتحدة تقيم الأخيرة على أراضيها أكثر من 50 قاعدة عسكرية ويكون بمقدور قواتها اعتقال المواطنين العراقيين وشن حملات عسكرية دون استشارة الحكومة العراقية والتمتع بالحصانة القانونية".واشارت إلى أن الولايات المتحدة لديها اتفاقيات أمنية مع دول كثيرة لكن أياً منها غير خاضع للإحتلال من قبل 151 ألف جندى أمريكى مثل العراق.ونسبت الصحيفة إلى مصدر عراقى لم تكشف عن هويته القول "إن الولايات المتحدة غير مستعدة حتى لإبلاغ الحكومة فى بغداد بالجداول الزمنية لدخول قواتها إلى بلادهم أو الخروج منها خشية قيامها بإطلاع الإيرانيين عليها".وكانت الإندبندانت ذكرت الخميس أن الولايات المتحدة تتفاوض على خطة سرية لإبقاء العراق تحت الإحتلال العسكرى الأمريكى لفترة غير محددة ستمنح قواتها حق السيطرة الدائمة على قواعدها والقيام بعمليات عسكرية واعتقال العراقيين دون استشارة حكومة بغداد والتمتع بالحصانة من القانون العراقى وستقوم بموجبها باقامة 50 قاعدة عسكرية فى العراق والسيطرة على مجاله الجوى فى إطار الحرب التى تقودها ضد الإرهاب
مع غياب الاحداث الدرامية في منطقة الشرق الاوسط، ركزت الصحف البريطانية الرئيسية الصادرة الجمعة على الملفين التقليديين وهما ملف العراق، الذي تحدثت فيه الصحافة البريطانية عن "ابتزاز" تمارسه الادارة الامريكية لاجبار الحكومة العراقية على توقيع اتفاقية امنية تضمن وجودا امريكا دائما في العراق، وتتحدث في الثاني عن رؤية مبعوث السلام الخاص الى المنطقة ورئيس الوزراء البريطاني السابق توني بلير في مسألة حلحلة الجمود في ملف الصراع الفلسطيني الاسرائيلي.
في صحيفة الاندنبندنت نقرأ عن الشأن العراقي حيث تقول ان الولايات المتحدة تحتجز نحو 50 مليار دولار من اموال العراق في بنكها المركزي في نيويورك وتستخدمها للضغط على الحكومة العراقية وارغامها على التوقيع على معاهدة تحالف امني استراتيجي يرى الكثير من العراقيين انها ستجعل من الوجود العسكري الامريكي في بلادهم دائميا، حسب معلومات تقول الصحيفة انها سربت اليها.
وتشير المعلومات الى تقول الصحيفة انها حصلت عليها الى ان المفاوضين الامريكيين يستخدمون ورقة 20 مليار دولار من اموال مجمدة بموجب قرارات قضائية امريكية ضد العراق للضغط على نظرائهم العراقيين من اجل القبول ببنود معاهدة امنية وعسكرية ظهرت اول تفاصيلها في ذات الصحيفة في عددها السابق، اي عدد الخميس.
وتقول الصحيفة ان الاحتياطيات المالية العراقية في الخارج محمية بأمر رئاسي امريكي يعطيها حصانة من الملاحقة القضائية، لكن الجانب الامريكي يقول انه في حال انقضاء مدة تفويض الامم المتحدة، وبدون وجود اتفاق يحل محله، ستفقد الاموال العراقية حصانتها تلك، وهو ما يعني خسارة العراق لنحو 20 مليار دولار.
وتضيف الاندنبندنت ان الولايات المتحدة قادرة على تهديد العراق بخسارة 40 في المئة من احتياطياته من العملة الصعبة لان استقلال العراق ما زال مقيدا بميراث الحصار الدولي المفروض عليه منذ غزو صدام حسين الكويت عام 1990، وهو ما يعني ان العراق ما زال يعتبر تهديدا للامن والاستقرار الدوليين بموجب البند السابع من ميثاق الامم المتحدة.
وتشير الصحيفة الى ان المفاوضين الامريكيين يقولون ان ثمن الافلات من قيود البند السابع هو التوقيع على معاهدة "تحالف استراتيجي" مع الولايات المتحدة.
وتقول الاندنبندنت ان تهديدات الجانب الامريكي تؤكد الالتزام الشخصي للرئيس الامريكي جورج بوش في الدفع باتجاه توقيع معاهدة تحالف كهذه قبل الحادي والثلاثين من يوليو/ تموز، وانها في الواقع اتفاقية بين العراق والولايات المتحدة، وهو ما دفع بوش الى عنونتها بـ "تحالف" حتى يتجنب تقديمها الى مجلس الشيوخ للحصول على الموافقة اللازمة.
ويقول العراقيون المنتقدون لهذه المعاهدة او الاتفاقية انها ستجعل العراق دولة تابعة او زبون من زبائن الولايات المتحدة تقيم الاخيرة فيها اكثر 50 قاعدة عسكرية.
وسيكون بمقدور القوات الامريكية اعتقال اي عراقي، وشن حملات عسكرية بدون الرجوع الى الحكومة العراقية، ولن يخضع الجنود او المتعاقدون الامريكيون الى المساءلة القانونية، اي انهم محصنون من اي ملاحقة من قبل القضاء العراقي.
وتضيف الاندنبندنت ان واشنطن كانت قد كررت نفيها انها تسعى الى اقامة قواعد عسكرية دائمة في العراق، لكن المفاوضين الامريكيين يقولون انه في حال وجود جندي واحد فقط خارج محيط سياج لتلك القواعد او المنشأة الامريكية، سيكون العراق، وليس الولايات المتحدة، هو المسؤول.

Revealed: Secret plan to keep Iraq under US control
Bush wants 50 military bases, control of Iraqi airspace and legal immunity for all American soldiers and contractors

A secret deal being negotiated in Baghdad would perpetuate the American military occupation of Iraq indefinitely, regardless of the outcome of the US presidential election in November.
The terms of the impending deal, details of which have been leaked to The Independent, are likely to have an explosive political effect in Iraq. Iraqi officials fear that the accord, under which US troops would occupy permanent bases, conduct military operations, arrest Iraqis and enjoy immunity from Iraqi law, will destabilise Iraq's position in the Middle East and lay the basis for unending conflict in their country.
But the accord also threatens to provoke a political crisis in the US. President Bush wants to push it through by the end of next month so he can declare a military victory and claim his 2003 invasion has been vindicated. But by perpetuating the US presence in Iraq, the long-term settlement would undercut pledges by the Democratic presidential nominee, Barack Obama, to withdraw US troops if he is elected president in November.
The timing of the agreement would also boost the Republican candidate, John McCain, who has claimed the United States is on the verge of victory in Iraq – a victory that he says Mr Obama would throw away by a premature military withdrawal.
America currently has 151,000 troops in Iraq and, even after projected withdrawals next month, troop levels will stand at more than 142,000 – 10 000 more than when the military "surge" began in January 2007. Under the terms of the new treaty, the Americans would retain the long-term use of more than 50 bases in Iraq. American negotiators are also demanding immunity from Iraqi law for US troops and contractors, and a free hand to carry out arrests and conduct military activities in Iraq without consulting the Baghdad government.
The precise nature of the American demands has been kept secret until now. The leaks are certain to generate an angry backlash in Iraq. "It is a terrible breach of our sovereignty," said one Iraqi politician, adding that if the security deal was signed it would delegitimise the government in Baghdad which will be seen as an American pawn.
The US has repeatedly denied it wants permanent bases in Iraq but one Iraqi source said: "This is just a tactical subterfuge." Washington also wants control of Iraqi airspace below 29,000ft and the right to pursue its "war on terror" in Iraq, giving it the authority to arrest anybody it wants and to launch military campaigns without consultation.
Mr Bush is determined to force the Iraqi government to sign the so-called "strategic alliance" without modifications, by the end of next month. But it is already being condemned by the Iranians and many Arabs as a continuing American attempt to dominate the region. Ali Akbar Hashemi Rafsanjani, the powerful and usually moderate Iranian leader, said yesterday that such a deal would create "a permanent occupation". He added: "The essence of this agreement is to turn the Iraqis into slaves of the Americans."
Iraq's Prime Minister, Nouri al-Maliki, is believed to be personally opposed to the terms of the new pact but feels his coalition government cannot stay in power without US backing.
The deal also risks exacerbating the proxy war being fought between Iran and the United States over who should be more influential in Iraq.
Although Iraqi ministers have said they will reject any agreement limiting Iraqi sovereignty, political observers in Baghdad suspect they will sign in the end and simply want to establish their credentials as defenders of Iraqi independence by a show of defiance now. The one Iraqi with the authority to stop deal is the majority Shia spiritual leader, Grand Ayatollah Ali al-Sistani. In 2003, he forced the US to agree to a referendum on the new Iraqi constitution and the election of a parliament. But he is said to believe that loss of US support would drastically weaken the Iraqi Shia, who won a majority in parliament in elections in 2005.
The US is adamantly against the new security agreement being put to a referendum in Iraq, suspecting that it would be voted down. The influential Shia cleric Muqtada al-Sadr has called on his followers to demonstrate every Friday against the impending agreement on the grounds that it compromises Iraqi independence.
The Iraqi government wants to delay the actual signing of the agreement but the office of Vice-President Dick Cheney has been trying to force it through. The US ambassador in Baghdad, Ryan Crocker, has spent weeks trying to secure the accord.
The signature of a security agreement, and a parallel deal providing a legal basis for keeping US troops in Iraq, is unlikely to be accepted by most Iraqis. But the Kurds, who make up a fifth of the population, will probably favour a continuing American presence, as will Sunni Arab political leaders who want US forces to dilute the power of the Shia. The Sunni Arab community, which has broadly supported a guerrilla war against US occupation, is likely to be split.

تنطلق إدعاءات كاذبة من عدد من المسؤولين والعملاء، وبخاصة من وزير الخارجية والقيادة الكردية وعملاء الولايات المتحدة في العراق، تضلل العراقيين، وتوهمهم بان عدم الموافقة على المعاهدة العراقية الأمريكية سوف تدفع الولايات المتحدة الأمريكية إلى ابقاء العراق تحت الفصل السابع من ميثاق الأمم المتحدة. وان التوقيع على هذه المعاهدة سوف تخلص العراق من الفصل السابع.
ونود أن نبين ما يأتي:
1. ان الفصل السابع لا يمنح مجلس الامن سلطة على الدول وانما تخضع المنازعات بين الدول لمراقبة مجلس الامن. فلا يطبق يطبق الفصل السابع على الدول مطلقا. ولا يوجد في الوقت الحاضر نزاع بين العراق ودولة اخرى. ولم يناقش مجلس الامن قضية تتعلق بالعراق.
2. عدم علاقة الوجود الامريكي في العراق بالفصل السابع من الميثاق. فالولايات المتحدة الأمريكية احتلت العراق بدون موافقة الأمم المتحدة. فلا ترابط قانوني بين المعاهدة واحتلال العراق.
3. أن الفصل السابع من الميثاق يتعلق بصلاحية مجلس الأمن في النظر في المنازعات الدولية لحماية السلم والأمن الدوليين واستخدام وسائل المنع أو القمع لمنع الحروب أو ما يهدد السلم والأمن الدوليين. وللمجلس أن يقرر خضوع أي نزاع بين الدول ولا يعني أنه يتخذ اجراءات وانما يعني انه يراقب الحالة أو الموقف، لربما يقع ما يهدد السلم والأمن الدوليين. وهناك اكثر من اربعين نزاعا دوليا تحت هذا الفصل دون أن يتخذ مجلس الأمن اية اجراءات بحقها. ونقول لا يوجد نزاع في الوقت الحاضر في العراق يراقبه مجلس الأمن. ولم ترفع اية دولة شكوى ضد العراق.
4. أن القرار 660/1990 صدر بصدد النزاع العراقي الكويتي واعتبر النزاع العراقي الكويتي، وليس العراق تحت الفصل السابع. وصدر القرار 661/1990 يقضي بالزام العراق بالانسحاب من الكويت لرفع حالة ما يهدد السلم والأمن الدوليين. وعندما انسحب العراق من الكويت، صدر القرار 687/1991 يقضي بفرض الحصار على العراق لحين التاكيد من تدمير اسلحة الدمار الشامل. ونص هذا القرار على أن رفع الحصار عن العراق يتحقق عندما تعلن لجان التفتيش بخلو العراق من اسلحة الدمار الشامل. ورفع الحصار يتم بدون موافقة مجلس الأمن وانما يحصل بصورة مباشرة لقرارات لجان التفتيش بخلو العراق من اسلحة الدمار الشامل. ولم يرفع الحصار عن العراق بسبب تعنت لجان التفتيش كما يعلم الجميع.
5. بعد احتلال العراق لم يتم العثور على اسلحة الدمار الشامل، باعتراف الولايات المتحدة الأمريكية، واستمرت لجان التفتيش بالبحث عن اسلحة الدمار الشامل. ورفعت تقريرها إلى مجلس الأمن اعلنت فيه خلو العراق من اسلحة الدمار الشامل. فصدر القرار 1762/2007 في 29/حزيران يونيو/2007 بالوثيقة المرقمة (S/RES/1762/20070 تضمن خلو العراق من اسلحة الدمار الشامل وبموجب القرار المذكور تم الغاء لجان التفتيش وانتهي الحصار ولا يوجد بعد ذلك علاقة لمجلس الأمن بالعراق. فنصت الفقرة الاولى منه على ما يأتي " يقرر على الفور إنهاء ولايتي لجنة الأمم المتحدة للرصد والتحقيق والتفتيش والوكالة الدولية للطاقة الذرية بموجب القرارات ذات الصلة". وبذلك انتهت علاقة مجلس الأمن بالعراق نهائيا.
6. أن اخضاع نزاع للفصل السادس لا يتطلب رفعه من قبل مجلس الأمن وانما يعني ذلك أن لمجلس الأمن أن يراقب النزاع. ولا يوجد في الوقت الحاضر نزاع يراقبه مجلس الأمن بخصوص العراق مع اية دولة. فقد انتهت علاقة مجلس الأمن بخصوص العراق. إذ لا يوجد أي نزاع في الوقت الحاضر. كما لا توجد اسلحة دمار شامل. واذا ما سلمنا جدلا بوجود نزاع بين العراق ودولة اخرى، وان هذا النزاع خاضع للفصل السادس، فمع ذلك لا يترتب اجراءات قانونية ضد العراق طالما لا توجد حالة تهدد السلم والأمن الدوليين. ونكرر القول أن عددا كبيرا من المنازعات الدولية تخضع للفصل السابع. فلا يعني ذلك أي شيء. فالفصل السابع لا يفرض على دولة وانما على نزاع بين دول.
7. ولابد من الاشارة إلى أن الناس يستفتون المرجعيات وليس المرجعيات تستفتي الناس. فهذه اول مرة تحصل في العراق. أن المرجعية تطلب استفتاء الشعب العراقي.. فما هو دور المرجعيات.. ويقصد منها التنصل من المسؤولية واعطاء الشرعية لهذه القوات. فقد سبرنا كيفية تزوير الانتخابات وما حصل فيها. لهذا نقول أن الاستفتاء يعني منح الشرعية لهذه القوات وليقول بوش للعالم أن الوجود الامريكي في العراق كانت بموافقة الشعب كله. ولا يعلم العالم كيف يتم الاستفتاء في العراق.
اننا نهيب بكل الاعلاميين من صحفيين ومراسلين ومقدمي برامج الاذاعية والفضائية ومواقع الانترنت تحمل مسؤوليتهم الوطنية وفضح وسائل الولايات المتحدة وكل العملاء وما يترتب على ذلك. والتأكيد على عدم علاقة المعاهدة المشؤومة المنوي عقدها بين العراق والولايات المتحدة. فهذه المعاهدة تقضي بيع ارض العراق وثرواته إلى الولايات المتحدة الأمريكية مقابل أن يبقى العملاء على الحكم. نرجو من كل اعلامي شريف ينتمي الى العراق العظيم ان يرد بكل قوة كل الاكاذيب التي تموه وتضلل العراقيين وتستغلهم.

While the point itself may not have more than Abbasid houses under the ground, it is adjacent to the palace of Sur Isa, the remains of which can be seen in the photo. While the initial construction might or might not touch the palace, accompanying activities will certainly spread over it.Sur Isa can be identified with the palace of al-Burj, built by the
Abbasid Caliph al-Mutawakkil, probably in 852-3 (Northedge, Historical Topography of Samarra, pp 125-127, 240). The palace is said to have cost 33 million dirhams, and was luxurious. Details are given by al-Shabushti, Kitab al-Diyarat.
Samarra was declared a World Heritage site by UNESCO at the end of June. The barracks could easily have been built elsewhere, off the archaeological site.--
