Iraq: 1,000 detainees held in 'shocking' conditions in makeshift holding centres in Anbar

More than 1,000 detainees, including some as young as 15, are being held without charge in horrendous conditions at makeshift holding centres in Anbar governorate, west of Baghdad, said Amnesty International today.
An Amnesty delegation led by the organisation’s Secretary General Salil Shetty gained access on 30 April to a centre run by Anbar’s counter-terrorism agency (Mukafahat al-Irhab) in Ameriyat al-Fallujah, where 683 male detainees are held without charge. The detainees are crammed into several rooms within a complex of disused warehouses being used as a detention and interrogation facility.

“It was a truly shocking sight - hundreds of human beings packed together like sardines in a tin and held in inhumane and degrading conditions for months on end.
“The detainees are squeezed into a space of less than one square metre each, sitting in a crouching position day and night, unable to stretch or lie down to sleep and are rarely allowed outside for fresh air."

قد لا يتعرف الكثيرون على القيسي عند اللقاء به شخصيا، او رؤية صوره المنشورة وهو يتحدث في الندوات. الا انهم ستعرفون 
عليه، حتما، حالما يرون صورته التي تم توزيعها في جميع انحاء العالم، واصبحت مطبوعة في الذاكرة الجماعية، عربيا وعالميا، كرمز للتعذيب في معتقل أبو غريب، ببغداد، من قبل قوات الاحتلال الأمريكي، وبصمت وتبرير الساسة العراقيين المتعاونين معه. علي شلال القيسي هو ذلك المعتقل الذي ارادوه بلا وجه ليحرموه من انسانيته، فاصبح وهو الموضوع على صندوق، مادا ذراعيه المربوطتين بالاسلاك الكهربائية جانبا، رمزا للأنسان المعذب، كاشفا عن الوجه القبيح لأدعياء حقوق الانسان. 
تزامن اصغائي للخلفي والقيسي مع انعقاد مجلس حقوق الإنسان التابع للأمم المتحدة، فى جنيف، في دورته الحادية والثلاثين. فما يجمع الاثنان، بالاضافة إلى تعرضهما للاعتقال والتعذيب، اختيارهما النشاط في مجال الدفاع عن حقوق الانسان، كطريقة يواصلان خلالها نضالهما السلمي، لتحقيق العدالة والكرامة. فأسس القيسي جمعية «ضحايا الاحتلال الأمريكي في العراق» وأسس الخلفي جمعية «صوت الأنسان» لتكون «صوت الانسان ضد القهر والظلم والقمع وطمس الحقائق من اي…كائن كان».
اختارا ان تكون تجربتهما لا اداة انتقام يتماثلون من خلالها مع الجلاد بل مسارا يتسامون فيه على نزعات الانتقام، لأيمانهما بانها ستقود، بالنتيجة، إلى خرابين : شخصي وعام. خراب الذات والبلد.

في رسالة مصورة موجهة إلى العالم، نسمع شابا عراقيا من سكان محافظة ديالى، شمال شرقي بغداد،يترحم على استشهاد شقيقه ثم يوجه بقلب لم يعد يتسع للمزيد من الموت، نداء لانقاذ ديالى التي تتعرض للذبح «فالجثث بالشوارع. وسيارات الميليشيات تجول الشوارع وتنادي عبر مكبرات الصوت، تطالب السكان من السنة بالخروج، تأمرهم بالرحيل والا قتلوا». ثم يتحدث بغضب عن الساسة المشاركين بالعملية السياسية على اساس تمثيل السنة، قائلا: «أطلع. استقيل. وصلت الدماء حد الركبة».

يعيش المواطن اليوم كابوسا، دائما، بلا ملامح. واذا كانت منظمة داعش قد تم تبنيها، سياسيا وإعلاميا، لتكون الوجه الأبرز في ترويع المواطن وإرهابه، فان حصره في زنزانات كونكريتية، بلا منافذ، وتعذيبه وقتله، من قبل ميليشيات، يطبل ويزمر لها باعتبارها البطل المنقذ، لايقل وحشية عن داعش.
واذا كانت صفة «المظلومية» قد استغلت، سياسيا، بشكل مشوه ليسيء، في النهاية، إلى ذات الطائفة التي استنبطت من أجلها، فانها وبدلا من تجاوزها كشرط أساسي للمحافظة على وطن يتسع للجميع، تم تكريسها، تاريخيا وأبديا، في ظل حكومات طائفية تشرعن الافعال الانتقامية.
ان الصمت على وحشية وجرائم الميليشيات، جريمة لا تغتفر، كما هو الصمت على جرائم المحتل، ايا كانت جنسيته، كما هو الصمت على جرائم داعش، كما هو الصمت على جرائم نظام لم يعد يمثل غير مصالح ذاتية لحفنة من الفاسدين، على كل المستويات، وتجاوزت الفساد المالي والاداري.

Dispatches: Iraq – Fanning the Flames, or Telling the Truth?

Human Rights Watch released a report today that extensively documents abuses of women in Iraq’s criminal justice system - illegal arrests, detention, extensive torture, and ill-treatment, including sexual abuse, during interrogations. We showed how Iraq’s hobbled judiciary frequently convicts women based on coerced confessions and secret informant testimony, and how women are often detained for months and even years without charge.
But, many people – activists, journalists, and above all, government officials – urged me not to release the report. Their fear: it might only inflame the sectarian violence that’s threatening to tear the country apart.
Violence in Iraq has reached levels not seen since the 2006-2007 civil war. Sectarian tensions are also extraordinarily high, fueled by ongoing fighting in Anbar province among Al-Qaeda, the Islamic State of Iraq and the Sham, other armed insurgents fighting both with and against the government, and Iraqi security forces, and by politicians’ jockeying for upcoming parliamentary elections. Iraqis fear that every attack and every report of abuse could trigger the next civil war.
Many of those who advised against releasing the report asked me whether I shouldn't lower my voice for a time, at least until things “blow over” – especially when it comes to talking about abuses that frequently appear to be sectarian: “Aren’t you throwing fuel on the fire?”
It’s a legitimate question. But it also tells me the discussion around why Iraq is in such acute crisis has strayed too far from the roots of the problem. Clearly Iraq needs to protect its citizens from armed groups’ violent attacks, which can wreak general havoc and cause a humanitarian crisis, as in Anbar. But the government also takes advantage of fears of the terrorist threat to brutally suppress dissent. The violence in Anbar is just the most recent example of how the government’s use of violent measures in the name of counterterrorism has accelerated the country’s crisis: the Anbar fighting began thanks to the government’s attempt to suppress Sunnis’ legitimate protests against abuses. Security forces’ brutal methods are amply documented in today’s report on abuses of women, which frequently occurred during counterterrorism operations.
The best way to refocus attention on the fuller causes of the abuses in Anbar, and the violence that, daily, threatens Iraqis throughout the country, is to raise, not quiet, our voices, to recall a critical source of the problem, and to redirect attention to a real solution – that is, the urgent need for the government to end rights violations and make good on its promises of reform.

For Iraqi women, America's promise of democracy is anything but liberation

A decade on from the US-led invasion of Iraq, the destruction caused by foreign occupation and the subsequent regime has had a massive impact on Iraqis' daily life – the most disturbing example of which is violence against women. At the same time, the sectarian regime's policy on religious garb is forcing women to retire their hard-earned rights across the spectrum: employment, freedom of movement, civil marriage, welfare benefits, and the right to education and health services.
Instead, they are seeking survival and protection for themselves and their families. But for many, the violence they face comes from the very institution that should guarantee their safety: the government. Iraqi regime officials often echo the same denials of the US-UK occupation authorities, saying that there are few or no women detainees. An increasing number of international and Iraqi human rights organizations reports otherwise.
The plight of women detainees was the starting point for the mass protests that have spread through many Iraqi provinces since 25 December 2012. Their treatment by the security forces has been a bleeding wound – and one shrouded in secrecy, especially since 2003. Women have been routinely detained as hostages – a tactic to force their male loved ones to surrender to security forces, or confess to crimes ascribed to them. Banners and placards carried by hundreds of thousands of protesters portray images of women behind bars pleading for justice.
According to Mohamed al-Dainy, an Iraqi MP, there was 1,053 cases of documented rape (pdf) cases by the occupying troops and Iraqi forces between 2003 and 2007. Lawyers acting on behalf of former detainees say that UK detention practices between 2003 and 2008 included unlawful killings, beatings, hooding, sleep deprivation, forced nudity and sexual humiliation, sometimes involving women and children. The abuses were endemic, allege the detainees' lawyers, arising from the "systems, management culture and training" of the British military.
These same occupation forces trained Iraqi forces. Abuses often occurred under the supervision of US commanders, who were unwilling to intervene, as the Washington Post reported:
"Of all the bloodshed in Iraq, none may be more disturbing than the campaign of torture and murder being conducted by US-trained government police forces."
In the aftermath of Abu Ghraib, detainees were handed over to Iraqi forces. This enabled them to be tortured, while occupation troops could disclaim responsibility.
Today, Iraq can boast one of the highest execution rates in the world. In a single day, 19 January 2012, 34 individuals, including two women, were executed – an act described by UN High Commissioner for Human RightsNavi Pillay as shocking:
"Given the lack of transparency in court proceedings, major concerns about due process and fairness of trials, and the very wide range of offences for which the death penalty can be imposed in Iraq."
No wonder, ten years after the invasion, the Iraqi authorities are accused by US-based Human Rights Watch of "violating with impunity the rights of Iraq's most vulnerable citizens, especially women and detainees". HRW's account is echoed by a report by the Iraqi parliament's own human rights and women, family and children's committees, which found that there are 1,030 women detainees suffering from widespread abuse, including threats of rape.
Responding to these findings, Prime Minister Nouri al-Maliki threatened to "arrest those members of parliament who had discussed the violence against women detainees". Meanwhile, Deputy Prime Minister Hussain al-Shahristani has acknowledged that there are 13,000 prisoners in custody accused of terror offences, but he only mentioned women detainees in passing:
"We transferred all women prisoners to prisons in their home provinces."
Al-Shahristani's statement is one in a long list of contradictory and misleading statements by the regime's most senior officials – from al-Maliki speaking of "not more than a handful of women terrorists", to his contradictory promise that he will pardon all "women detainees who have been arrested without a judicial order or in lieu of a crime committed by some of their male relatives". That assurance was followed by parading nine women, cloaked in black from head to toe, on the official state TV channel, al-Iraqiya, as a gesture of the regime's "good will".
Protesters and Iraqi human rights organizations estimate that there are as many as 5,000 female detainees. The truth is leaking out, drip by drip. A few weeks ago, 168 women detainees were released and there were promises of another 32 waiting to be released. No one accused of torture, rape or abuse has yet been brought to justice.
And it was all supposed to be so different. That was what Iraqi women were promised.
A political quota system, established in post-invasion Iraq, was designed to ensure that at least 25% of the members of the parliament were women. That was applauded as a great achievement of the "New Iraq" – compared with 8% female representation under Ba'athist regime. But this token statistic has repeatedly been trotted out to cover up the regime's crimes against women.
In reality, the al-Maliki government has since dispensed with the quota for government posts: there is only one woman minister among 44 positions. But even this appointment contains a grim irony: the minister for women's affairs, Ibtihal al-Zaidi, didn't hesitate to announce:
"I am against the equality between men and woman. If women are equal to men, they are going to lose a lot."
Perhaps unsurprisingly, many women's organisations have demanded the abolition of the ministry of women's affairs after the minister adopted a position against, rather than for, women's rights.
Human rights, including women's rights, are a litmus test for democracy. Statements by senior officials, including the prime minister himself, show that – contrary to what some Iraqis had hoped for – the "liberators" have actually set the conditions for the continuity of injustice. And that, in turn, gives rise to extremism.

سلام عليك ايتها العراقية وانت تواصلين البقاء والمقاومة

يمر اليوم العالمي لمناهضة العنف ضد المرأة على المرأة العراقية كالقطار العابر للمحطات المهجورة. فلا الانوار مضاءة في المحطة ولا الارصفة مأهولة. صوتها يرتطم بالفراغ فلا صدى. المرأة العراقية، هل تتذكرونها؟ المرأة التي كانت عزة العراق ورمز كبريائه. المرأة التي ساهمت ببناء وطن أملت ان يكون لكل الابناء. المرأة التي عاشت سنوات الحصار عزيزة النفس غير خانعة. المرأة التي استخدمتها الادارة الامريكية ومؤيديها من ساسة النظام الحالي، كسبب 'انساني' لتبرير غزو العراق واحتلاله وتخريبه بعد اكذوبة اسلحة الدمار الشامل. كيف تتذكرونها؟ هل هي التي تحدث عنها بول بريمر، حاكم الاحتلال العسكري الامريكي، رئيس سلطة الائتلاف المؤقتة، القائل في 2 ايلول/ سبتمبر 2003، قائلا: 
'الشعب العراقي حر الآن، وليس لديه ما يدعو للقلق من الشرطة السرية القادمة لالقاء القبض عليه في منتصف الليل، وليس هناك ما يدعو النساء للقلق على أزواجهن وإخوانهن الذين يلقى القبض عليهم ثم يقتلون. وليس من داع لقلق الرجال على زوجاتهم اللواتي يتم اقتيادهن الى غرف الاغتصاب.
تلك الأيام قد ولت. ' أم انها من خاطبها الرئيس الامريكي السابق جورج بوش، بـ'انسانية' وسعى لـ 'تحريرها'، كما قال، في يوم عالمي آخر، حول 'الجهود الرامية إلى تعزيز حقوق المرأة على الصعيد العالمي ' في 12 آذار/ مارس 2004: 'كل امرأة في العراق أفضل حالا لأن غرف الاغتصاب وغرف التعذيب تحت نظام صدام حسين أغلقت إلى الأبد '. ولئلا ادخل في سرد يؤرخ للانتهاكات والجرائم والمداهمات والتعذيب والاغتصاب الموثق للنساء والرجال معا (هل هو الهدف الجديد للمساواة؟) في ظل حكومات الاحتلال المتعاقبة واطولها عمرا نظام حزب الدعوة الطائفي برئاسة نوري المالكي و'رئيس الجمهورية' جلال طالباني، ساشير الى تقرير منظمة تقرير هيومن رايتس ووتش، لعام 2011، وهو واحد من مئات التقارير الدولية، والذي جاء فيه ذكر حقيقة لايتطرق اليها الشك وهي: 'تنتهك حقوق المواطنين العراقيين الأكثر ضعفا، لا سيما النساء والمحتجزين، مع الإفلات من العقاب'. 
كما ذكرت منظمة العفو الدولية في تقريرها الصادر في 12 أيلول 2011، ان هناك ما لا يقل عن 30 ألف معتقل في السجون العراقية لم تصدر بحقهم أحكام قضائية، معرضين للتعذيب وسوء المعاملة، من بينهم نساء. ولم يعد خافيا على احد كيفية معاملة النساء في معتقلات نظام حزب الدعوة بحيث صارت رائحة التعذيب النتنة وممارسة الجلادين تستدعي 'استنكار وادانة' بعض المشاركين في العملية السياسية. ولننظر الى احداث اسبوع واحد ذات علاقة بانتهاكات حقوق المراة. ففي يوم 26 نوفمبر، اتهم القيادي في القائمة العراقية حامد المطلك، الأجهزة الأمنية باغتصاب وتعذيب سجينات عراقيات، واصفا الحال بانه 'أخزى' من أفعال الأميركيين في سجن أبو غريب، وأن 'هناك حملة لاعتقال النساء بدلا من أزواجهن أو إخوانهن عن طريق المخبر السري وبتهمة أربعة إرهاب'. وأضاف المطلك في مؤتمر صحافي أن '12 امرأة اعتقلت في منطقة التاجي، في الثالث من الشهر الحالي، بينهن صبيتان أحداهن تبلغ من العمر 11 عاما وأخرى 12'. مؤكداً تسجيل وفيات جراء التعذيب شملت نساء ورجالاً وأطفالاً.
والمفارقة المبكية في تصريح 'القيادي' هو تحذيره من انعكاس الافعال (يعني اعتقال وتعذيب واغتصاب الفتيات) 'سلبا على مشروع الوحدة الوطنية'! مشروع الوحدة الوطنية! مما يدفعنا الى التساؤل عما يتناوله ساسة النظام لينطقوا بكذا تصريحات بدلا من اعلان الانسحاب من عملية سياسية لوثت منذ تأسيسها كل القيم الاخلاقية والانسانية المتعارف عليها؟ 
وقبله بيومين، في 24 تشرين الثاني / نوفمبر، كشف النائب أحمد العلواني المنتمي الى ذات القائمة الهمامة، تعرض نزيلات في عدد من السجون العراقية إلى حالات 'اغتصاب' من قبل محققين لانتزاع اعترافات قسرية. وبدلا من ان يستقيل النائب الجسور بعد اطلاعه على هذه الجرائم البشعة والتي لو اصابت مواطنا واحدا في بلد ديمقراطي حقا لأسقطت الحكومة بكاملها، أكد أن قائمته ستطلب من رئاسة البرلمان تشكيل لجنة لمتابعة هذه القضية. فالف مبروك للمرأة على تشكيل اللجنة (هل سمع احد بنتيجة تحقيق احدى اللجان حتى اليوم؟) وألف مبروك على وجود 'القائمة العراقية' الفخورة بانها، خلافا للاحزاب الطائفية، تضم بين صفوفها ناشطات نسويات مدافعات عن المرأة لا يتقاعسن، يوما، عن حضور محترفات حقوق المرأة والديمقراطية ومشاركتها في الحياة السياسية ووضع الحلول المناسبة لجميع المشكلات!
في ذات اليوم، أصدر مرصد الحريات الصحافية بيانا عن الصحفية صباح حسن، رئيسة تحرير صحيفة 'الرأي الحر' ببغداد، المعتقلة منذ العشرين من فبراير الماضي أي قبل أكثر من عشرة أشهر والتي، حسب ابنتها وتقارير طبية موثقة، تشير الى تعرضها (للتعذيب الوحشي بالضرب والكي بالسجائر عدا عن تعريتها بالكامل والتنكيل بها ونقلها بالبطانية من مديرية الجرائم الكبرى الى سجن تكريت وسط المدينة امام انظار المنتسبين). ويبين الصحافي هادي مرعي جلو، مدير المرصد، نقلا عن ابنة الصحافية المعتقلة: 'إن والدتها تقبع في حال سيئة للغاية بمركز إعتقال يقع جوار وزارة الداخلية العراقية' مطالبا بإطلاق سراحها على الفور والتحقيق مع المتسببين بنسبة الضرر العالية في جسدها. 
وبعده بيوم، في 25 تشرين الثاني/ نوفمبر، خرجت تظاهرة حاشدة في محافظة الانبار، غرب العراق، احتجاجا على اعتقال امرأة وطالب المتظاهرون الحكومة المركزية باطلاق سراح المرأة وسراح جميع المعتقلات العراقيات في سجون الحكومة وايقاف الانتهاكات التي يتعرضن لها.
واذا ما انتقلنا الى اقليم كردستان فان العديد من الناشطات في مجال حقوق المرأة، من بينهن كزال نجم الدين، في تصريح لها لبي يوكي ميديا، يؤكدن ان المجتمع الكوردستاني يشهد قسوة في التعامل مع المرأة تصل الى حد القتل، وتعود الاسباب الى 'عدم جدية واستقلالية الجهات القضائية في مثل هذه القضايا، بالرغم من القوانين والتشريعات التي أصدرها برلمان الاقليم للحد من هذه الظاهرة، الا ان شيئا فعليا وجادا لم يحصل على الاطلاق'. وقد ذكر تقرير اصدره (برنامج العدالة في متناول الجميع ـ وارفن)، المدعوم من قبل الادارة الامريكية، بتاريخ 25 تشرين الثاني/ نوفمبر من العام الحالي، ان هناك، خلال الشهرين السابقين فقط، 19 أمراة قتلت و 55 أمرأة احرقت نفسها وان أكثر من 740 حالة انتحار لنساء أحرقن أنفسهن سجلت خلال الستة أشهر الأولى من العام الحالي فقط!
فما الذي فعله مجلس النواب في 'العراق الديمقراطي الجديد' بعضوية الاسلاميين الطائفيين والشيوعيين والقوميين؟ قدمت لجنة حقوق الإنسان البرلمانية تقريراً اولياً عن المعتقلات في السجون العراقية، مبينة أن 'عدد الموقوفات والمحكومات لغاية يوم 27 نوفمبر في وزارة الداخلية 101 امرأة وفي وزارة العدل 960 امرأة وفي وزارة العمل 69 امراة معتقلة او محكومة... واشارت إلى اعتقال 12 امرأة في منطقة التاجي بضواحي بغداد الشرقية بدلا عن المطلوبين من اقاربهن وتم احتجازهن دون أوامر قضائية'. 
تم اقتراح اصدار بيان بمناسبة اليوم العالمي لمناهضة العنف ضد المرأة. حدثت مشادة كلامية بين النواب حول تضمين حال المعتقلات. رفعت الجلسة تفاديا لتحول المجلس الى حلبة مصارعة جسدية. ثم، كالعادة، انخرط 'شركاء العملية السياسية' في تبادل الاتهامات عبر الفضائيات والتهديد بفتح ملفات الارهاب مقابل المتاجرة بشرف العراقيات. 
من هو المسؤول عن اعتقال وتعذيب المرأة العراقية؟ هل هو الجلاد لوحده أم انه النظام الذي يمنح الجلاد الأذن بالتعذيب والاغتصاب عن طريق عدم المساءلة وعدم تنفيذ القانون. ان الجلاد الموجود في ظلمات المعتقلات السرية والعلنية ومراكز التحقيق التابعة بثلاث وزارات على الاقل ليس شبحا لايعرفه أحد. انه جزء لايتجزأ من نظام يتشدق بوزرائه ونوابه وساسته بحقوق الانسان حتى باتت حقوق الانسان شتيمة مقززة. انها مسؤولية الجميع في النظام. الصامتون والمبررون والمتنازعون اعلاميا.

التعذيب وازدواجية معايير الاخوان المسلمين

منذ لجوئه الى اقليم كردستان، و'نائب رئيس الجمهورية' طارق الهاشمي، يتحدث مدافعا بقوة عن حقوق الانسان، اما بشكل شخصي او من خلال بيانات مكتبه (آخرها الثلاثاء الماضي)، داعيا الى 'كشف المستور عن واقع السجون والمعتقلات في العراق وما يحصل من انتهاكات... ووجود سجون سرية تحوي معتقلين يتعرضون الى ابشع صنوف التعذيب الجسدي والنفسي لاجبارهم على التوقيع على اعترافات غير صحيحة'. 
وتتزامن هذه التصريحات المكثفة عن كشف ' المستور' من المعتقلات والتعذيب بعد ان اتهمه رئيس الوزراء نوري المالكي بالارهاب مهددا، بدوره، بكشف 'المستور' من ملفات 'الارهاب' الهاشمي. 
ولقضية الاتهامات المتبادلة ما بين الهاشمي والمالكي، ومن لف لفهما ضمن العملية السياسية، ما هو ابعد من الارتياح الى فكرة ' اذا اختلف الحرامية ظهر المسروق'. فالقضية تجاوزت المسروق أو المنهوب الذي بلغ المليارات، الى قضية انسانية أعمق وأثمن وهي حقوق الانسان. وهي القضية الاهم، مهما كانت الظروف، اذا ما اردنا تجاوز الوضع الآني المبني، منذ تسع سنوات، على الانتقام الشخصي، وبمفارقة محزنة، تحت مبرر التعرض للاعتقال والتعذيب والتهجير سابقا. وهو تبرير صار يقودنا كالعميان الى الحكم على ابنائنا واحفادنا بالموت اعتقالا وتعذيبا وتهجيرا. ولن يتم تصحيح الاوضاع مالم يوضع حد لدائرة العنف المستشرية في نظام مبني على التقسيم الطائفي والعرقي والديني ووفق منظور ضيق لايتسع لكل المواطنين بل يستند الى ان (كل إمرىء لنفسه وتبا للأخرين)، وبالعامية العراقية عن الأنانية اليومية التي تكاد تجعلها عادية : 'كل واحد يحود النار لخبزته'. وهو منظور لا يأخذ بالحسبان أذى الآخرين.
ان وفاة ثلاثة من افراد حماية طارق الهاشمي نتيجة التعذيب الشديد لانتزاع اعترافات كاذبة (حسب بيان مكتب الهاشمي) عن قيامهما والهاشمي بـ'عمليات ارهابية' هو جريمة يجب ان يعاقب عليها من اقترفها ويتحمل مسؤوليتها كل من اطلع على تفاصيلها من المسؤولين، وعلى رأسهم المالكي، ولم يتخذ موقفا واضحا وصريحا منها. ان نفي بعض الجهات الرسمية لتعذيب ووفاة رجال الحماية لا يكفي. كما لا يكفي نفي وجود معتقلات سرية يستمرىء الجلادون فيها الممارسات اللاانسانية واللا اخلاقية. فجرائم القتل والتعذيب وانعدام القضاء العادل والتحقيق النزيه تملأ صفحات مئات التقارير الدولية حول انتهاكات حقوق الانسان في العراق. وما هو مطلوب وبسرعة هو قيام لجان دولية مستقلة باجراء التحقيقات حول كل المعتقلين والسجون السرية وكيفية انتزاع الاعترافات وتحديد مسؤولية النظام القائم عن ذلك، بعيدا عن محاصصة لجان التحقيق، بانواعها، التي يتم الاعلان عن تشكيلها، بالكيلو، من قبل حكومة المالكي.
هذا من ناحية التعامل المؤقت مع جرائم حكومة المالكي، الامين العام لحزب الدعوة الشيعي. ماذا عن مسؤولية طارق الهاشمي الذي كان امينا عاما للحزب الاسلامي السني (حركة الاخوان المسلمين) قبل ان يطلب اعفاءه من منصبه حالما تم تعيينه نائبا لرئيس الجمهورية 'مدركا عظم المسؤولية الملقاة على عاتقه'؟ ما الذي قدمه الى المواطنين من خدمات ليساوي شرعنة حكومة طائفية ساهم في اضفاء صبغة 'الوطنية' عليها وهو الذي يعلم جيدا انها حكومة احتلال وتقسيم ونهب، والاكثر من ذلك كله انها حكومة تحتقر المواطن ولا تدخر سبيلا في الانتقام منه واهانته، ولم توفر له ابسط حقوق الانسان؟ 
ان الهاشمي الذي يقدم نفسه، كضحية لنظام المالكي 'الطائفي القمعي'، حسب تصريحاته الاخيرة، كان حتى الأمس القريب من دعائم ذات النظام الطائفي القمعي وجزءا لايتجزأ من 'العملية السياسية' التي مكنت حكومات ظل الاحتلال من شراء الوقت لبناء قواتها الاستخبارية والخاصة والقمعية الحالية. وكان الهاشمي في مسايرته لحكومات الاحتلال مكملا لخطى الحزب الاسلامي (الاخوان المسلمين) الذي قايض حركة المقاومة ضد المحتل بأول منصب عرض عليه من قبل الحاكم العسكري الامريكي بول بريمر في مجلس الحكم، وحال استدعاء أمينه العام د. محسن عبد الحميد للقاء الحاكم. وبرر الحزب (مثل الحزب الشيوعي) العمل مع قوات الاحتلال بذريعة القبول بالامر الواقع، و' ملء الفراغ السياسي والمشاركة مع بقية الأحزاب في القرارات المصيرية'. 
وكانت قمة قراراته المصيرية التوقيع على المعاهدة الامنية ومعاهدة الاطار الاستراتيجي مع الولايات المتحدة الامريكية 'بشرط اجراء استفتاء شعبي' في شهر تموز (يوليو) 2009، والا اعتبرت الاتفاقية باطلة، او هكذا اوهم ' الأخوان' بقية المواطنين. ومر شهر تموز ومرت السنوات ودفن شرط الاستفتاء الشعبي في مقبرة الاكاذيب المتراكمة.
وكان ' شرط' مشابه قد استخدم لتمرير الدستور، وهاهو الدستور، كما هو بعد سنوات، مصانا معصوما مقدسا لا يمسه أحد بل يرتكزون اليه كمرجعية مطلقة في كل صغيرة وكبيرة. وبقي الهاشمي، كما الأخوان، يعزفون على وتر ' تمثيل السنة'، في سباق محموم مع الاحزاب العازفة على وتر 'تمثيل الشيعة'، والشعب غارق في محنة يتغدى عليها الطرفان. ولتوضيح صورة النفاق السياسي الأخواني اكثر، فلنقرأ سوية بعض الفقرات من كلمة ألقاها طارق الهاشمي 'نائب رئيس جمهورية العراق'، في 'القمة الثالثة لمؤتمر التفاعل وبناء الثقة في اسيا' الذي عقد في اسطنبول، حزيران 2010. ولنراجع معا وصفه الاوضاع في العراق، وهي ذات الاوضاع التي يصفها بالقمعية والطائفية، حاليا، بعد تجريده من منصبه او بعد انتهاء مدة صلاحيته للعمل في ذات الحكومة. يخبرنا الهاشمي في كلمته: 'لقد نجح العراق في التغلب على العديد من التحديات التي واجهت مسيرة بناء العراق الجديد منذ سقوط النظام السابق عام 2003، واستطاع لأول مرة أن يبني مؤسسات ديمقراطية من خلال صناديق الاقتراع، ولديه الآن مجالس محلية ووطنية تشريعية منتخبة بإرادة حرة، كما لديه دستور دائم، وصحافة حرة، ومؤسسات مجتمع مدني'. 
ويؤكد الهاشمي، لكل من يخامره الشك بوجود هذه المواصفات وبارادة الشعب الحرة 'إننا فعلاً نبني عراقاً جديداً يعوض أبناءه سنوات الحرمان والحصار والحروب، ويضمن مستقبلاً لائقاً وحياة كريمة لأجياله القادمة، كما يساهم بجد وبصدق في تحقيق الأمن والاستقرار في المنطقة والعالم... وعبر السنوات الماضية حقق العراق قفزات نوعية في المجالات السياسية والاقتصادية والخدمية وغيرها'. كما يؤكد الهاشمي بصراحته واستقامته: 'ولم يعد التحدي الأمني عائقاً كما كان بعد نجاحات متميزة في فرض القانون والنظام'.
ان مسؤولية الهاشمي وغيره في الحزب الاسلامي (امتداد حركة الاخوان المسلمين) كبيرة في خداع الناس وتزوير الوعي بادعاءاتهم التبريرية حول تمثيل السنة، وشرعنة حكومة الاحتلال وتقديمها الى المواطنين باعتبارها حكومة ' الشراكة والتكافؤ الوطني'، فضلا عن سكوتهم على 'المستور' الى ان يصيبهم الفأس بالرأس فيبدأون التلميح والتهديد، ملقين اللوم على الجانب الآخر، بدون الاعتراف بالمسؤولية. ان صراع الطوائف طامة كبرى لن تنتج مشروعا وطنيا مهما كانت ذرابة ألسن الساسة. واذا لم نسرع بايجاد الحلول الحقيقية ووضع حد لها ستزيد، يوما بعد يوم، من حجم خسائرنا البشرية والمادية.

                         م/ كم من ليث في سجونهم لا يُسمع له صوت  
نستنكر وبشدة العمل البربري الذي قامت به حكومة المنطقة الخضراء متمثلة بقيادة شرطة بغداد التي قامت بإهانة المعتقل ليث الدليمي ورفاقه في قاعة المؤتمر الصحفي وقبلها تعذيبهم لأخذ اعترافات كاذبة وسياسية منهم , وبغض النظر إن كان ليث الدليمي بريء أم متهم فان ما حصل يوم أمس في القاعة من إذلال وإهانة وتمييز طائفي مقيت لا يجب أن يقف عندها أي عراقي غيور وشريف , وإذا ما عرفنا أن ليث الدليمي هو عضو مجلس محافظة بغداد فهنا يكون تساؤلنا ماذا حصل ويحصل لباقي المعتقلين الذين يقبعون منذ سنوات في سجون العراق من زاخو إلى الفاو وإذ كان ليث قد تجرئ واسمع صوته للعالم فمن سيوصل صوت المظلومين في غياهب السجون ؟ نحن في الحركة الشعبية لإنقاذ العراق إذ نستنكر هذا العمل البربري نؤكد على إنه لا يوجد شخص لديه حصانة في العراق لا مواطن ولا سياسي في ضل هذه الحكومة القمعية المستبدة وان كنا نمني النفس بأن يتذوق كل من دخل العملية السياسية ما ذاقه المعتقلين في سجون الحكومة منذ عام 2003 ليعلموا أي حيف وضيم وقع على أبناء شعبهم وهم ساكتون خانعون ينعمون بأموال العراق ! وما صراخ ليث الدليمي إلى بسبب الظلم الذي وقع عليه فكم من ليث في سجون العراق لا يصل صوته لإسماعنا وبعد كل ما تقدم نطالب المنظمات الدولية بالتدخل لإنقاذ المعتقلين ومنهم السيد ليث الدليمي الذي يتعرض ألان لأبشع تعذيب حسب ماوصلتنا من معلومات ونؤكد على إن التحضيرات قائمة على قدم وساق لاعتصام سنطالب به بإطلاق سراح المعتقلين الأبرياء في سجون بغداد وشمال العراق وهذا اضعف الأيمان ...

explanation : Laith Mustapha Hemoud Al Dulaimy, member of Iraq provincial council was arrested on the 25th May on 'terrorism charges'. A tape of his confession was going to be aired in a press conference, when he and his fellow prisoner stood up and said the whole thing is staged and the confessions were extracted under torture.

We strongly deplore the barbaric action of insulting the detainee Laith al-Dulaimi carried out by the Government of the Green Zone, represented by the leadership of the Baghdad police  and his colleagues in the hall of the press conference. We are disgusted to learn that they used torture to extract false confessions for political purposes. These confessions are then used to indict them under the Terrorism act. Regardless of whether Laith al-Dulaimi, is innocent or not, what took place yesterday in the Conference Hall of humiliation and sectarian insults should have been stopped by any decent human being let alone an Iraqi claiming to be honorable and responsible. And if this is how Laith al-Dulaimi,  a member of the Baghdad Provincial Council is treated we fear that the other prisoners who are languishing for years in the prisons of Iraq, from Zakho (near Turkish border) to Fao (the southern most town) fare even worse.

Laith had the opportunity to dare raise his voice to the world to expose the torture affecting him and his fellow prisoners, who would convey the voice of the thousands oppressed and languishing for years in the prisons up and down the country? We in the Popular Movement to save Iraq condemn this barbaric behaviour. It appears that no Iraqi citizen no matter what his/her position is immune from human rights violations and torture  under this repressive and authoritarian government. We wish that the players of this political process would have a ‘small taste’ of  the hell the detainees in the prisons of the government since 2003 have experienced /are experiencing. We wish they would experience first hand, the injustice and grievance experienced by their own people while they are enjoying Iraq’s riches.
We  managed to hear Laith al-Dulaimi ‘s call to stop the injustices, how many Laiths are there in the prisons of Iraq whose voices we do not hear?
We call on international organizations to intervene to save the detainees, including Mr. Laith al-Dulaimi. We received information that Laith is now at the end of worst torture practices since his outburst.
We are preparing for a protest calling for the release of innocent detainees in the prisons of Baghdad and northern Iraq, and ‘that is weakest form of action our religious duty demands’   [this is the least we should do]...

Report: Raids and arbitrary arrests Feb 2012


اكد قسم حقوق الإنسان في هيئة علماء المسلمين ان الاجهزة الحكومية المختلفة نفذت في شهر شباط المنصرم ( 177 ) حملة دهم وتفتيش ظالمة اعتقلت خلالها (1178) مواطنا بريئا، بينهم (11) أمرأة .

 واوضح القسم في بيان اصدرته الهيئة اليوم ان حملات الاعتقال الجائرة التي طالت ( 14 ) محافظة، نالت محافظة ديالى النصيب الاكبر منها حيث شهدت اعتقال (335) من ابنائها، تلتها محافظة نينوى (188) معتقلاً، ثم صلاح الدين ( 181 )، فيما توزعت الاعتقالات الاخرى بواقع ( 145) في العاصمة بغداد، و(117) في محافظة ميسان، و ( 54 ) في بابل، و ( ( 50 ) في البصرة، و ( 39 ) في الانبار، و ( 27 ) في التأميم و ( 17 ) في القادسية، و ( 11 ) في واسط، وستة معتقلين في كل من ذي قار وكربلاء ، فيما شهدت محافظة المثنى اعتقال اثنين من ابنائها .

وأكد البيان ان هذه الإحصائية اقتصرت على البيانات الرسمية التي اعلنتها وزارتا الداخلية والدفاع الحاليتين فقط؛ ولم تتضمن الاعتقالات التي تنفذها ما تسمى وزارة الأمن الوطني، والمكاتب التابعة لرئيس الحكومة الحالية، والتي يجري التكتم عليها عادة، كما انها لم تتضمن الاعتقالات العشوائية التي تقوم بها الميليشيات والأجهزة الأمنية الكردية بمسمياتها المختلفة في محافظات ( ديالى والتأميم وصلاح الدين ونينوى، والسليمانية وأربيل ودهوك ).

وفي ختام بيانها حملت هيئة علماء المسلمين، حكومة الاحتلال الخامسة مسؤولية هذه الاعتقالات التعسفية التي حولت حولت العراق الجريح ـ وبشهادة العالم أجمع ـ إلى سجن كبير ترتكب فيه أبشع الجرائم باسم الحرية والديمقراطية المزيفة .. مجددة مطالبتها للهيئات والمنظمات الدولية المعنية بحقوق الإنسان ومنظمة التعاون الإسلامي، وجامعة الدول العربية، بالتدخل الجاد لوقف هذه الانتهاكات الصارخة وفضح مرتكبيها، والعمل على اطلاق سراح جميع المعتقلين الأبرياء .

The Department of Human Rights in the Association Muslim Scholars in Iraq issued a report on the Raids and arbitrary arrests carried out during February 2012  by different government agencies : (177) campaign of raids and searches unjust and arrested (1178) innocent citizens, including (11) women   which affected (14) provinces. Diyala province, got the largest share of which witnessed arrest (335), followed by the province of Nineveh (188) detainees, then Salah al-Din (181), while the distributed arrests by the other (145) in the capital, Baghdad, and (117) in the province of Maysan, and (54) in Babylon, and ((50) in Basra, and (39) in the province, and (27) in the nationalization and (17) in Qadisiyah, and (11) in Wasit, and six prisoners in each of the Dhi Qar, Karbala, Muthanna province has seen in the arrest of two sons.

The statement emphasized that these statistics were limited to official data released by the Ministries of Interior and Defense current only; did not include arrests carried out by the so-called Department of Homeland Security, office of the President of the current government, which is being hush them normally, as it did not include arbitrary arrests carried out by militias Kurdish security forces and a spade in the various provinces (Diyala, Tamim, Salahuddin and Nineveh, and Sulaymaniyah, Erbil and Dohuk).

In closing, she carried the Association of Muslim Scholars, the fifth occupation government responsible for these arbitrary detentions that have turned turned the wounded Iraq and the testimony of the whole world into a big prison where the most heinous crimes committed in the name of freedom and democracy fake .. Renewed its demand for the bodies and international organizations concerned with human rights and the Organization of Islamic cooperation, and the Arab League, hard to intervene to stop this flagrant violations and expose the perpetrators, and to release all innocent detainees.

From the angle of the photo, it is possible to calculate that the complex is being built at E 396388 N 3785995 (UTM Zone 38 North) or Lat. 34.209760° Long. 43.875325°, to the west of the Malwiya (Spiral Minaret), and behind the Spiral Cafe.
While the point itself may not have more than Abbasid houses under the ground, it is adjacent to the palace of Sur Isa, the remains of which can be seen in the photo. While the initial construction might or might not touch the palace, accompanying activities will certainly spread over it.Sur Isa can be identified with the palace of al-Burj, built by the
Abbasid Caliph al-Mutawakkil, probably in 852-3 (Northedge, Historical Topography of Samarra, pp 125-127, 240). The palace is said to have cost 33 million dirhams, and was luxurious. Details are given by al-Shabushti, Kitab al-Diyarat.
Samarra was declared a World Heritage site by UNESCO at the end of June. The barracks could easily have been built elsewhere, off the archaeological site.--
