“في رسالة مصورة موجهة إلى العالم، نسمع شابا عراقيا من سكان محافظة ديالى، شمال شرقي بغداد،يترحم على استشهاد شقيقه ثم يوجه بقلب لم يعد يتسع للمزيد من الموت، نداء لانقاذ ديالى التي تتعرض للذبح «فالجثث بالشوارع. وسيارات الميليشيات تجول الشوارع وتنادي عبر مكبرات الصوت، تطالب السكان من السنة بالخروج، تأمرهم بالرحيل والا قتلوا». ثم يتحدث بغضب عن الساسة المشاركين بالعملية السياسية على اساس تمثيل السنة، قائلا: «أطلع. استقيل. وصلت الدماء حد الركبة».

يعيش المواطن اليوم كابوسا، دائما، بلا ملامح. واذا كانت منظمة داعش قد تم تبنيها، سياسيا وإعلاميا، لتكون الوجه الأبرز في ترويع المواطن وإرهابه، فان حصره في زنزانات كونكريتية، بلا منافذ، وتعذيبه وقتله، من قبل ميليشيات، يطبل ويزمر لها باعتبارها البطل المنقذ، لايقل وحشية عن داعش.
واذا كانت صفة «المظلومية» قد استغلت، سياسيا، بشكل مشوه ليسيء، في النهاية، إلى ذات الطائفة التي استنبطت من أجلها، فانها وبدلا من تجاوزها كشرط أساسي للمحافظة على وطن يتسع للجميع، تم تكريسها، تاريخيا وأبديا، في ظل حكومات طائفية تشرعن الافعال الانتقامية.
ان الصمت على وحشية وجرائم الميليشيات، جريمة لا تغتفر، كما هو الصمت على جرائم المحتل، ايا كانت جنسيته، كما هو الصمت على جرائم داعش، كما هو الصمت على جرائم نظام لم يعد يمثل غير مصالح ذاتية لحفنة من الفاسدين، على كل المستويات، وتجاوزت الفساد المالي والاداري.

International Lawyers Seek Justice for Iraqis

The conference represents the most powerful and most current organized attempt in the world to bring justice to those responsible for the catastrophe in Iraq, and included powerful international lawyers like International Court of Justice lawyer Curtis Doebbler and Louie Roberto Zamora Bolanos, a lawyer from Costa Rica who successfully sued the government of his country for supporting the war in Iraq.
Their goal for the conference was to begin taking concrete steps toward international lawsuits that will bring former UK Prime Minister Tony Blair and former US President George W. Bush, along with those responsible in their administrations, to justice for the myriad war crimes committed in Iraq.

Dispatches: Iraq – Fanning the Flames, or Telling the Truth?

Human Rights Watch released a report today that extensively documents abuses of women in Iraq’s criminal justice system - illegal arrests, detention, extensive torture, and ill-treatment, including sexual abuse, during interrogations. We showed how Iraq’s hobbled judiciary frequently convicts women based on coerced confessions and secret informant testimony, and how women are often detained for months and even years without charge.
But, many people – activists, journalists, and above all, government officials – urged me not to release the report. Their fear: it might only inflame the sectarian violence that’s threatening to tear the country apart.
Violence in Iraq has reached levels not seen since the 2006-2007 civil war. Sectarian tensions are also extraordinarily high, fueled by ongoing fighting in Anbar province among Al-Qaeda, the Islamic State of Iraq and the Sham, other armed insurgents fighting both with and against the government, and Iraqi security forces, and by politicians’ jockeying for upcoming parliamentary elections. Iraqis fear that every attack and every report of abuse could trigger the next civil war.
Many of those who advised against releasing the report asked me whether I shouldn't lower my voice for a time, at least until things “blow over” – especially when it comes to talking about abuses that frequently appear to be sectarian: “Aren’t you throwing fuel on the fire?”
It’s a legitimate question. But it also tells me the discussion around why Iraq is in such acute crisis has strayed too far from the roots of the problem. Clearly Iraq needs to protect its citizens from armed groups’ violent attacks, which can wreak general havoc and cause a humanitarian crisis, as in Anbar. But the government also takes advantage of fears of the terrorist threat to brutally suppress dissent. The violence in Anbar is just the most recent example of how the government’s use of violent measures in the name of counterterrorism has accelerated the country’s crisis: the Anbar fighting began thanks to the government’s attempt to suppress Sunnis’ legitimate protests against abuses. Security forces’ brutal methods are amply documented in today’s report on abuses of women, which frequently occurred during counterterrorism operations.
The best way to refocus attention on the fuller causes of the abuses in Anbar, and the violence that, daily, threatens Iraqis throughout the country, is to raise, not quiet, our voices, to recall a critical source of the problem, and to redirect attention to a real solution – that is, the urgent need for the government to end rights violations and make good on its promises of reform.

فحص العذرية يلاحق العراقيات

تواجه نساء عراقيات اوامر قضائية تنص على اجراء فحوص عذرية لهن عشية الزواج، او حتى بعد الليلة الاولى، ما يعرض المراة لاحراج كبير، ولخطر اكبر ايضا.

ويجري معهد الطب العدلي في بغداد يوميا عدة فحوص للعذرية في غرفة صغيرة تشمل سريرا طبيا اسود ينتهي 

بمسندين للقدمين، ومجهرا مخصصا لعملية الفحص، ومصباحا كهربائيا متحركا.

BAGHDAD — Iraqi women face court-ordered virginity tests that often show they were virgins until marriage but shame them nonetheless, doctors at an institute that carries out the tests and a lawyer told AFP.

Remaining a virgin until marriage can be an issue of life or death for women in the Middle East, where those who are seen as having dishonored the family by having premarital sex are sometimes killed by male relatives.

An average of several virginity tests are performed per day at the Medical Legal Institute (MLI) in Baghdad, in a small windowless room with blue-tiled walls and a black table with leg stirrups at one end.

Other equipment includes a white scope on a wheeled stand and a bright white light, also on wheels, near the end of the table.

"Most of the cases we received after the first day of marriage," said Dr. Munjid al-Rezali, the director of the MLI.

"The husband claims that she is not a virgin, and then the family bring her here, through the courts, this all come through the courts, and we examine her," Rezali said, speaking in English.

"It's not uncommon, we are seeing a lot," he added.

The tests include examination of the woman's hymen, but the man involved may also come under scrutiny.

The man may be tested for impotency, Rezali said, noting that in some cases, a man with erectile dysfunction may pretend the woman was not a virgin to hide his shame.

The results of the tests go directly to the courts, and are not given by the MLI to the parties involved, Rezali said.

"They think that during the marriage, (the) first day of marriage, there should be blood ... they think if there is no blood, there is no virginity," said Dr. Sami Dawood, a forensic doctor at the MLI who has been involved in the tests.

This belief, he said, indicates that sex education and knowledge is "very poor."

If a man thinks his new wife is not a virgin, he may take the issue to court, leading to the MLI performing a virginity test, said Dawood.

Asked about the results of the tests, Dawood said that "most of them (are) with the woman, not against the woman, but it is by itself... shaming."

However, he said that while women were killed in the past if blood was not found on the sheets after their wedding night, people now seek recourse through the courts and the virginity tests procedure.

The test, which takes between 15 and 30 minutes, is carried out by three doctors, at least one of them a woman, and the results are certified by two others, said Dawood, adding that the tests are done only when ordered by a court.

"The judge is required to send the woman for the medical test when she is accused by her husband of not being a virgin, and that is only done in this case," lawyer Ali Awad Kurdi said.

"If it is proved that the woman was not virgin and sought to get married without telling the man, there is no law that protects her," Kurdi said.

The woman's family is then required to recompense the man for gifts, money and other expenditures related to the relationship.

Various Iraqi judicial officials either declined to speak about the issue, or could not be reached by AFP.

"Non-governmental organizations do not have any means of protecting women from this accusation of this crime, because it is a very sensitive matter," said Intisar al-Mayali, an activist from the Iraqi Women's Association, a local rights group.

Marianne Mollmann, senior policy adviser for rights group Amnesty International, called virginity tests both wrong and ineffective.

"The issue of virginity testing, and forced virginity testing and sort of legal virginity tests in court proceedings or in other ways, violate a whole host of human rights and are just not justifiable," she said.

"Even if it were legitimate to look at whether women were virgins for whatever reason, which it's not, you can't use a virginity test for that, because the hymen might break for any reason," Mollmann said.

The test "doesn't do what it's set out to do."

Liesl Gerntholtz, the director of the Women's Rights Division at Human Rights Watch, said: "The Iraqi government should urgently put measures in place to ensure that women and girls are not forced to undergo physical examinations that are degrading, painful and frightening."

"The use of these tests in court should be banned."

التعذيب وازدواجية معايير الاخوان المسلمين

منذ لجوئه الى اقليم كردستان، و'نائب رئيس الجمهورية' طارق الهاشمي، يتحدث مدافعا بقوة عن حقوق الانسان، اما بشكل شخصي او من خلال بيانات مكتبه (آخرها الثلاثاء الماضي)، داعيا الى 'كشف المستور عن واقع السجون والمعتقلات في العراق وما يحصل من انتهاكات... ووجود سجون سرية تحوي معتقلين يتعرضون الى ابشع صنوف التعذيب الجسدي والنفسي لاجبارهم على التوقيع على اعترافات غير صحيحة'. 
وتتزامن هذه التصريحات المكثفة عن كشف ' المستور' من المعتقلات والتعذيب بعد ان اتهمه رئيس الوزراء نوري المالكي بالارهاب مهددا، بدوره، بكشف 'المستور' من ملفات 'الارهاب' الهاشمي. 
ولقضية الاتهامات المتبادلة ما بين الهاشمي والمالكي، ومن لف لفهما ضمن العملية السياسية، ما هو ابعد من الارتياح الى فكرة ' اذا اختلف الحرامية ظهر المسروق'. فالقضية تجاوزت المسروق أو المنهوب الذي بلغ المليارات، الى قضية انسانية أعمق وأثمن وهي حقوق الانسان. وهي القضية الاهم، مهما كانت الظروف، اذا ما اردنا تجاوز الوضع الآني المبني، منذ تسع سنوات، على الانتقام الشخصي، وبمفارقة محزنة، تحت مبرر التعرض للاعتقال والتعذيب والتهجير سابقا. وهو تبرير صار يقودنا كالعميان الى الحكم على ابنائنا واحفادنا بالموت اعتقالا وتعذيبا وتهجيرا. ولن يتم تصحيح الاوضاع مالم يوضع حد لدائرة العنف المستشرية في نظام مبني على التقسيم الطائفي والعرقي والديني ووفق منظور ضيق لايتسع لكل المواطنين بل يستند الى ان (كل إمرىء لنفسه وتبا للأخرين)، وبالعامية العراقية عن الأنانية اليومية التي تكاد تجعلها عادية : 'كل واحد يحود النار لخبزته'. وهو منظور لا يأخذ بالحسبان أذى الآخرين.
ان وفاة ثلاثة من افراد حماية طارق الهاشمي نتيجة التعذيب الشديد لانتزاع اعترافات كاذبة (حسب بيان مكتب الهاشمي) عن قيامهما والهاشمي بـ'عمليات ارهابية' هو جريمة يجب ان يعاقب عليها من اقترفها ويتحمل مسؤوليتها كل من اطلع على تفاصيلها من المسؤولين، وعلى رأسهم المالكي، ولم يتخذ موقفا واضحا وصريحا منها. ان نفي بعض الجهات الرسمية لتعذيب ووفاة رجال الحماية لا يكفي. كما لا يكفي نفي وجود معتقلات سرية يستمرىء الجلادون فيها الممارسات اللاانسانية واللا اخلاقية. فجرائم القتل والتعذيب وانعدام القضاء العادل والتحقيق النزيه تملأ صفحات مئات التقارير الدولية حول انتهاكات حقوق الانسان في العراق. وما هو مطلوب وبسرعة هو قيام لجان دولية مستقلة باجراء التحقيقات حول كل المعتقلين والسجون السرية وكيفية انتزاع الاعترافات وتحديد مسؤولية النظام القائم عن ذلك، بعيدا عن محاصصة لجان التحقيق، بانواعها، التي يتم الاعلان عن تشكيلها، بالكيلو، من قبل حكومة المالكي.
هذا من ناحية التعامل المؤقت مع جرائم حكومة المالكي، الامين العام لحزب الدعوة الشيعي. ماذا عن مسؤولية طارق الهاشمي الذي كان امينا عاما للحزب الاسلامي السني (حركة الاخوان المسلمين) قبل ان يطلب اعفاءه من منصبه حالما تم تعيينه نائبا لرئيس الجمهورية 'مدركا عظم المسؤولية الملقاة على عاتقه'؟ ما الذي قدمه الى المواطنين من خدمات ليساوي شرعنة حكومة طائفية ساهم في اضفاء صبغة 'الوطنية' عليها وهو الذي يعلم جيدا انها حكومة احتلال وتقسيم ونهب، والاكثر من ذلك كله انها حكومة تحتقر المواطن ولا تدخر سبيلا في الانتقام منه واهانته، ولم توفر له ابسط حقوق الانسان؟ 
ان الهاشمي الذي يقدم نفسه، كضحية لنظام المالكي 'الطائفي القمعي'، حسب تصريحاته الاخيرة، كان حتى الأمس القريب من دعائم ذات النظام الطائفي القمعي وجزءا لايتجزأ من 'العملية السياسية' التي مكنت حكومات ظل الاحتلال من شراء الوقت لبناء قواتها الاستخبارية والخاصة والقمعية الحالية. وكان الهاشمي في مسايرته لحكومات الاحتلال مكملا لخطى الحزب الاسلامي (الاخوان المسلمين) الذي قايض حركة المقاومة ضد المحتل بأول منصب عرض عليه من قبل الحاكم العسكري الامريكي بول بريمر في مجلس الحكم، وحال استدعاء أمينه العام د. محسن عبد الحميد للقاء الحاكم. وبرر الحزب (مثل الحزب الشيوعي) العمل مع قوات الاحتلال بذريعة القبول بالامر الواقع، و' ملء الفراغ السياسي والمشاركة مع بقية الأحزاب في القرارات المصيرية'. 
وكانت قمة قراراته المصيرية التوقيع على المعاهدة الامنية ومعاهدة الاطار الاستراتيجي مع الولايات المتحدة الامريكية 'بشرط اجراء استفتاء شعبي' في شهر تموز (يوليو) 2009، والا اعتبرت الاتفاقية باطلة، او هكذا اوهم ' الأخوان' بقية المواطنين. ومر شهر تموز ومرت السنوات ودفن شرط الاستفتاء الشعبي في مقبرة الاكاذيب المتراكمة.
وكان ' شرط' مشابه قد استخدم لتمرير الدستور، وهاهو الدستور، كما هو بعد سنوات، مصانا معصوما مقدسا لا يمسه أحد بل يرتكزون اليه كمرجعية مطلقة في كل صغيرة وكبيرة. وبقي الهاشمي، كما الأخوان، يعزفون على وتر ' تمثيل السنة'، في سباق محموم مع الاحزاب العازفة على وتر 'تمثيل الشيعة'، والشعب غارق في محنة يتغدى عليها الطرفان. ولتوضيح صورة النفاق السياسي الأخواني اكثر، فلنقرأ سوية بعض الفقرات من كلمة ألقاها طارق الهاشمي 'نائب رئيس جمهورية العراق'، في 'القمة الثالثة لمؤتمر التفاعل وبناء الثقة في اسيا' الذي عقد في اسطنبول، حزيران 2010. ولنراجع معا وصفه الاوضاع في العراق، وهي ذات الاوضاع التي يصفها بالقمعية والطائفية، حاليا، بعد تجريده من منصبه او بعد انتهاء مدة صلاحيته للعمل في ذات الحكومة. يخبرنا الهاشمي في كلمته: 'لقد نجح العراق في التغلب على العديد من التحديات التي واجهت مسيرة بناء العراق الجديد منذ سقوط النظام السابق عام 2003، واستطاع لأول مرة أن يبني مؤسسات ديمقراطية من خلال صناديق الاقتراع، ولديه الآن مجالس محلية ووطنية تشريعية منتخبة بإرادة حرة، كما لديه دستور دائم، وصحافة حرة، ومؤسسات مجتمع مدني'. 
ويؤكد الهاشمي، لكل من يخامره الشك بوجود هذه المواصفات وبارادة الشعب الحرة 'إننا فعلاً نبني عراقاً جديداً يعوض أبناءه سنوات الحرمان والحصار والحروب، ويضمن مستقبلاً لائقاً وحياة كريمة لأجياله القادمة، كما يساهم بجد وبصدق في تحقيق الأمن والاستقرار في المنطقة والعالم... وعبر السنوات الماضية حقق العراق قفزات نوعية في المجالات السياسية والاقتصادية والخدمية وغيرها'. كما يؤكد الهاشمي بصراحته واستقامته: 'ولم يعد التحدي الأمني عائقاً كما كان بعد نجاحات متميزة في فرض القانون والنظام'.
ان مسؤولية الهاشمي وغيره في الحزب الاسلامي (امتداد حركة الاخوان المسلمين) كبيرة في خداع الناس وتزوير الوعي بادعاءاتهم التبريرية حول تمثيل السنة، وشرعنة حكومة الاحتلال وتقديمها الى المواطنين باعتبارها حكومة ' الشراكة والتكافؤ الوطني'، فضلا عن سكوتهم على 'المستور' الى ان يصيبهم الفأس بالرأس فيبدأون التلميح والتهديد، ملقين اللوم على الجانب الآخر، بدون الاعتراف بالمسؤولية. ان صراع الطوائف طامة كبرى لن تنتج مشروعا وطنيا مهما كانت ذرابة ألسن الساسة. واذا لم نسرع بايجاد الحلول الحقيقية ووضع حد لها ستزيد، يوما بعد يوم، من حجم خسائرنا البشرية والمادية.

نستنكر وبشدة العمل البربري الذي قامت به حكومة المنطقة الخضراء متمثلة بقيادة شرطة بغداد التي قامت بإهانة المعتقل ليث الدليمي ورفاقه في قاعة المؤتمر الصحفي وقبلها تعذيبهم لأخذ اعترافات كاذبة وسياسية منهم , وبغض النظر إن كان ليث الدليمي بريء أم متهم فان ما حصل يوم أمس في القاعة من إذلال وإهانة وتمييز طائفي مقيت لا يجب أن يقف عندها أي عراقي غيور وشريف , وإذا ما عرفنا أن ليث الدليمي هو عضو مجلس محافظة بغداد فهنا يكون تساؤلنا ماذا حصل ويحصل لباقي المعتقلين الذين يقبعون منذ سنوات في سجون العراق من زاخو إلى الفاو وإذ كان ليث قد تجرئ واسمع صوته للعالم فمن سيوصل صوت المظلومين في غياهب السجون ؟ نحن في الحركة الشعبية لإنقاذ العراق إذ نستنكر هذا العمل البربري نؤكد على إنه لا يوجد شخص لديه حصانة في العراق لا مواطن ولا سياسي في ضل هذه الحكومة القمعية المستبدة وان كنا نمني النفس بأن يتذوق كل من دخل العملية السياسية ما ذاقه المعتقلين في سجون الحكومة منذ عام 2003 ليعلموا أي حيف وضيم وقع على أبناء شعبهم وهم ساكتون خانعون ينعمون بأموال العراق ! وما صراخ ليث الدليمي إلى بسبب الظلم الذي وقع عليه فكم من ليث في سجون العراق لا يصل صوته لإسماعنا وبعد كل ما تقدم نطالب المنظمات الدولية بالتدخل لإنقاذ المعتقلين ومنهم السيد ليث الدليمي الذي يتعرض ألان لأبشع تعذيب حسب ماوصلتنا من معلومات ونؤكد على إن التحضيرات قائمة على قدم وساق لاعتصام سنطالب به بإطلاق سراح المعتقلين الأبرياء في سجون بغداد وشمال العراق وهذا اضعف الأيمان ...

We wish they would experience first hand, the injustice and grievance experienced by their own people while they are enjoying Iraq’s riches.
We  managed to hear Laith al-Dulaimi ‘s call to stop the injustices, how many Laiths are there in the prisons of Iraq whose voices we do not hear?
We call on international organizations to intervene to save the detainees, including Mr. Laith al-Dulaimi. We received information that Laith is now at the end of worst torture practices since his outburst.
We are preparing for a protest calling for the release of innocent detainees in the prisons of Baghdad and northern Iraq, and ‘that is weakest form of action our religious duty demands’   [this is the least we should do]...
