Robert Fisk: US troops say goodbye to Iraq

Torture. Corruption. Civil war. America has certainly left its mark

Friday, 20 August 2010

When you invade someone else's country, there has to be a first soldier – just as there has to be a last.

The first man in front of the first unit of the first column of the invading American army to reach Fardous Square in the centre of Baghdad in 2003 was Corporal David Breeze of the 3rd Battalion, Fourth Marine Regiment. For that reason, of course, he pointed out to me that he wasn't a soldier at all. Marines are not soldiers. They are Marines. But he hadn't talked to his mom for two months and so – equally inevitably – I offered him my satellite phone to call his home in Michigan. Every journalist knows you'll get a good story if you lend your phone to a soldier in a war.

"Hi, you guys," Corporal Breeze bellowed. "I'm in Baghdad. I'm ringing to say 'Hi! I love you. I'm doing fine. I love you guys.' The war will be over in a few days. I'll see you soon." Yes, they all said the war would be over soon. They didn't consult the Iraqis about this pleasant notion. The first suicide bombers – a policeman in a car and then two women in a car – had already hit the Americans on the long highway up to Baghdad. There would be hundreds more. There will be hundreds more in Iraq in the future.

Yes, officially they are there to train the gunmen and militiamen and the poorest of the poor who have joined the new Iraqi army, whose own commander does not believe they will be ready to defend their country until 2020. But they will still be in occupation – for surely one of the the "American interests" they must defend is their own presence – along with the thousands of armed and indisciplined mercenaries, western and eastern, who are shooting their way around Iraq to safeguard our precious western diplomats and businessmen. So say it out loud: we are not leaving.

Instead, the millions of American soldiers who have passed through Iraq have brought the Iraqis a plague. From Afghanistan – in which they showed as much interest after 2001 as they will show when they start "leaving" that country next year – they brought the infection of al-Qa'ida. They brought the disease of civil war. They injected Iraq with corruption on a grand scale. They stamped the seal of torture on Abu Ghraib – a worthy successor to the same prison under Saddam's vile rule – after stamping the seal of torture on Bagram and the black prisons of Afghanistan. They sectarianised a country that, for all its Saddamite brutality and corruption, had hitherto held its Sunnis and Shias together.

And because the Shias would invariably rule in this new "democracy", the American soldiers gave Iran the victory it had sought so vainly in the terrible 1980-88 war against Saddam. Indeed, men who had attacked the US embassy in Kuwait in the bad old days – men who were allies of the suicide bombers who blew up the Marine base in Beirut in 1983 – now help to run Iraq. The Dawa were "terrorists" in those days. Now they are "democrats". Funny how we've forgotten the 241 US servicemen who died in the Lebanon adventure. Corporal David Breeze was probably two or three-years-old then.

But the sickness continued. America's disaster in Iraq infected Jordan with al-Qa'ida – the hotel bombings in Amman – and then Lebanon again. The arrival of the gunmen from Fatah al-Islam in the Nahr al-Bared Palestinian camp in the north of Lebanon – their 34-day war with the Lebanese army – and the scores of civilian dead were a direct result of the Sunni uprising in Iraq. Al-Qa'ida had arrived in Lebanon. Then Iraq under the Americans re-infected Afghanistan with the suicide bomber, the self-immolator who turned America's soldiers from men who fight to men who hide.

Anyway, they are busy re-writing the narrative now. Up to a million Iraqis are dead. Blair cares nothing about them – they do not feature, please note, in his royalties generosity. And nor do most of the American soldiers. They came. They saw. They lost. And now they say they've won. How the Arabs, surviving on six hours of electricity a day in their bleak country, must be hoping for no more victories like this one.

Then and now

3,000 The estimated number of Iraqi civilians killed last year. That's less than a tenth of the 34,500 killed in 2007 but it's still testament to the dangers faced each day by Iraqis.

200 The number of Iraqis known to be still held in US custody – a fraction of the 26,000 held in military prisons three years ago.

15.5 The average number of hours of electricity a day Baghdad receives, a marked impovement from the six hours it got three years ago but still not up to pre-invasions standards, when Iraqi cities could rely on 24-hour power.

America The US isn't leaving Iraq, it's rebranding the occupation

  • For most people in Britain and the US, Iraq is already history. Afghanistan has long since taken the lion's share of media attention, as the death toll of Nato troops rises inexorably. Controversy about Iraq is now almost entirely focused on the original decision to invade: what's happening there in 2010 barely registers.

That will have been reinforced by Barack Obama's declaration this week that US combat troops are to be withdrawn from Iraq at the end of the month "as promised and on schedule". For much of the British and American press, this was the real thing: headlines hailed the "end" of the war and reported "US troops to leave Iraq".

Nothing could be further from the truth. The US isn't withdrawing from Iraq at all – it's rebranding the occupation. Just as George Bush's war on terror was retitled "overseas contingency operations" when Obama became president, US "combat operations" will be rebadged from next month as "stability operations".

But as Major General Stephen Lanza, the US military spokesman in Iraq, told the New York Times: "In practical terms, nothing will change". After this month's withdrawal, there will still be 50,000 US troops in 94 military bases, "advising" and training the Iraqi army, "providing security" and carrying out "counter-terrorism" missions. In US military speak, that covers pretty well everything they might want to do.

Granted, 50,000 is a major reduction on the numbers in Iraq a year ago. But what Obama once called "the dumb war" goes remorselessly on. In fact, violence has been increasing as the Iraqi political factions remain deadlocked for the fifth month in a row in the Green Zone. More civilians are being killed in Iraq than Afghanistan: 535 last month alone, according to the Iraqi government – the worst figure for two years.

And even though US troops are rarely seen on the streets, they are still dying at a rate of six a month, their bases regularly shelled by resistance groups, while Iraqi troops and US-backed militias are being killed in far greater numbers and al-Qaida – Bush's gift to Iraq – is back in business across swaths of the country. Although hardly noticed in Britain, there are still 150 British troops in Iraq supporting US forces.

Meanwhile, the US government isn't just rebranding the occupation, it's also privatising it. There are around 100,000 private contractors working for the occupying forces, of whom more than 11,000 are armed mercenaries, mostly "third country nationals", typically from the developing world. One Peruvian and two Ugandan security contractors were killed in a rocket attack on the Green Zone only a fortnight ago.

The US now wants to expand their numbers sharply in what Jeremy Scahill, who helped expose the role of the notorious US security firm Blackwater, calls the "coming surge" of contractors in Iraq. Hillary Clinton wants to increase the number of military contractors working for the state department alone from 2,700 to 7,000, to be based in five "enduring presence posts" across Iraq.

The advantage of an outsourced occupation is clearly that someone other than US soldiers can do the dying to maintain control of Iraq. It also helps get round the commitment, made just before Bush left office, to pull all American troops out by the end of 2011. The other getout, widely expected on all sides, is a new Iraqi request for US troops to stay on – just as soon as a suitable government can be stitched together to make it.

What is abundantly clear is that the US, whose embassy in Baghdad is now the size of Vatican City, has no intention of letting go of Iraq any time soon. One reason for that can be found in the dozen 20-year contracts to run Iraq's biggest oil fields that were handed out last year to foreign companies, including three of the Anglo-American oil majors that exploited Iraqi oil under British control before 1958.

The dubious legality of these deals has held back some US companies, but as Greg Muttitt, author of a forthcoming book on the subject, argues, the prize for the US is bigger than the contracts themselves, which put 60% of Iraq's reserves under long-term foreign corporate control. If output can be boosted as sharply as planned, the global oil price could be slashed and the grip of recalcitrant Opec states broken.

The horrific cost of the war to the Iraqi people, on the other hand, and the continuing fear and misery of daily life make a mockery of claims that the US surge of 2007 "worked" and that Iraq has come good after all.

It's not only the hundreds of thousands of dead and 4 million refugees. After seven years of US (and British) occupation, tens of thousands are still tortured and imprisoned without trial, health and education has dramatically deteriorated, the position of women has gone horrifically backwards, trade unions are effectively banned, Baghdad is divided by 1,500 checkpoints and blast walls, electricity supplies have all but broken down and people pay with their lives for speaking out.

Even without the farce of the March elections, the banning and killing of candidates and activists and subsequent political breakdown, to claim – as the Times did today – that "Iraq is a democracy" is grotesque. The Green Zone administration would collapse in short order without the protection of US troops and security contractors. No wonder the speculation among Iraqis and some US officials is of an eventual military takeover.

The Iraq war has been a historic political and strategic failure for the US. It was unable to impose a military solution, let alone turn the country into a beacon of western values or regional policeman. But by playing the sectarian and ethnic cards, it also prevented the emergence of a national resistance movement and a humiliating Vietnam-style pullout. The signs are it wants to create a new form of outsourced semi-colonial regime to maintain its grip on the country and region. The struggle to regain Iraq's independence has only just begun.

Attacks Complicate U.S. Moves in Iraq

New york Times
Published: September 8, 2009
BAGHDAD — In the worst day of violence against American soldiers in Iraq since combat troops moved out of the cities this year, two bombings left four Americans dead, underscoring the dangers troops here still face even as they prepare for their exit from this country.

The American military provided little detail about the attacks, saying only that one soldier was killed in a roadside bombing in southern Baghdad and that three more were killed in another roadside bombing in northern Iraq.

While the American presence here has been greatly diminished, with Iraqis and Americans rarely conducting joint patrols and Iraqis eager to appear in control of their own security, there are still thousands of American soldiers working as advisers inside cities and towns across Iraq. Tens of thousands more are also on the road every night as Americans move equipment and resources in preparation for the large-scale reduction of forces scheduled to begin after January elections here.

One critical calculation is how the Americans can both provide the protection needed to move the vast accumulation of equipment from six years of war and maintain the capacity to support Iraqi forces if violence spins out of control.

Iraq’s security forces also continued to come under attack on Tuesday, with at least 10 police officers, including a police commander, killed and 6 more wounded in Kirkuk Province.

While Iraq’s police and army have long been targets of insurgents, August was the deadliest month for them since the Americans withdrew combat troops from the cities in late June, with 32 members killed. Since January, 164 Iraqi police officers and army soldiers have been killed.

The strategy of those committing violence in Iraq, never easy to divine, is particularly difficult to gauge when dealing with attacks on police officers in local areas.

Insurgents, of course, seek to destabilize the government. But there are also networks and overlays of crime, corruption, political power plays, ethnic rivalries and local factions in competition for control over vital areas.

In few places do those tensions form as combustible a mix as they do in Kirkuk Province, known as the country’s fault line because of the simmering tensions between the central government in Baghdad and the autonomous region of Iraqi Kurdistan to the north. The deadliest attacks against Iraqi police officers on Tuesday took place around the city of Kirkuk. In one bombing in the town of Armeli, populated with Shiites from Iraq’s Turkmen ethnic minority, the local police commander was killed along with three other officers when his convoy struck a roadside bomb. In a separate attack in the same area, four other police officers were killed.

The continuing tensions in Kirkuk Province are an increasing focus for American commanders here, who have announced a new initiative to try and bring stability to the factions competing for power in the area. The details of the campaign, and how American troops will be involved, remain unclear.

There were also attacks against the Iraqi police in Baghdad on Tuesday, with at least six officers wounded in two bombings.

Another bombing in Baghdad took aim at an official in the Health Ministry, killing one of his employees and wounding 12 more people. But the official emerged unharmed.

Even as security forces are singled out, civilians here often bear the brunt of the violence, with 4,111 people killed around the country so far this year.

The continuing violence has raised questions about the ability of Iraqi forces to maintain security as the American role shrinks, especially after deadly attacks in the heart of the capital last month left roughly 100 people dead.

Seeking to address those doubts, the Iraqi government on Tuesday announced that 29 police and army officers arrested after that bombing were being charged with negligence in the performance their duties.

“There was clear negligence from the security forces,” said Maj. Gen. Qassim Atta, the spokesman for the Baghdad’s security command center. “Absolutely, what has been achieved so far in the intelligence and security efforts is below expectations.”

An Iraqi employee of The New York Times contributed reporting from Kirkuk Province.

Iraq PM admits US troops may stay

The Iraqi prime minister has admitted US troops could stay in the country beyond 2011.

Under the US-Iraq Status of Forces agreement, which sets out a timetable for the withdrawal of US forces from Iraq, American troops must exit the country by December 31, 2011.

But Nouri al-Maliki said at the US Institute of Peace in Washington on Thursday: "The security relations between the Americans and the Iraqis ... is a relationship based on co-operation and all the foundations and rules that were put forth in the agreements.

"Nevertheless, if the Iraqis require further training and support we shall examine this at that time, based on the needs of Iraq."

His comments mark a shift in his position and come less than a month after US troops pulled out of Iraq's towns and cities, handing sole control of security in the areas to domestic security forces.

Change in stance

Rob Reynolds, Al Jazeera's Washington correspondent, said: "We have heard talks from al-Maliki and other figures in the Iraqi government about how they are moving ahead with national reconciliation for years now - without much visible progress.

"The Iraqi government and Maliki insist that the Iraqi security forces are sufficiently trained and equipped to handle security in the country but, at the same time, both Maliki and Obama say that if they get in trouble the Iraqis can call on the Americans for help."

Al-Maliki declared a national holiday in Iraq on June 30th when US forces left Iraq's urban centres and returned to their barracks, saying that the pullout was a key step in re-establishing Iraqi sovereignty.

Sam Parker of the US Institute for Peace told Al Jazeera that the Iraqi leader is now trying to make amends with the US government and military, members of which had criticised Maliki's reaction to the US pullback.

"The disconnect between what he says in Iraq and what he says here is all about politics and playing to a domestic constituency versus playing to the foreign power that provides his government with the support that's essential for its functioning," he said.

Deadline set

Al-Maliki's apparent willingness for US forces to stay in Iraq beyond the 2011 deadline comes a day after he met Barack Obama, the US president, at the White House.

Speaking afterwards, Obama said: "Going forward, we will continue to provide training and support for Iraqi security forces that are capable and non-sectarian.

"We will move forward with our strategy to responsibly remove American combat brigades from Iraq by the end of next August and fulfil our commitment to remove all American troops from Iraq by the end of 2011."

Analysts say that Obama needs the troop redeployment to go to schedule so that he can send soldiers to Afghanistan, where US and Nato forces are fighting the Taliban.

al-akhbar.com

Sami Ramadani : Sofa so disastrous

Sami Ramadani
guardian.co.uk, Friday 28 November 2008 15.00 GMT

Encircled by US tanks and marines, stationed in and around the heavily fortified Green Zone in Baghdad, Iraq's "sovereign" parliament has approved two military, economic, cultural, and diplomatic pacts with the US. The one that has captured the headlines is the status of forces agreement (Sofa). The much more important pact, the strategic framework agreement (SFA), was slipped through almost unnoticed. A copy of it was not available even to the US congress.
A sizable minority in parliament, led by the popular Sadrist block, now 29 members after the assassination of a leading member last month, and 6 of the recalcitrant members of the government factions, attended the parliamentary session and voted against.
The pacts went through amid chaotic scenes, by 144 against 35 votes. 19 walked out before the vote and more than 70 didn't show up. The pacts were nodded through after days of murky behind-the-scenes bargaining between the corrupt leaders of the pro-US sectarian factions within the government.
To understand how freely these pacts have been negotiated and approved one has to imagine Iraqi tanks, led by prime minister Maliki, occupying the lawns at the White House and surrounding Congress while dictating Iraqi terms to Bush and co. The scene outside would include the total destruction of America's infrastructure, over 10 million Americans killed within five years, one million prisoners, 50 million refugees within and outside the US, mainly in Mexico and Canada, the assassination of thousands of the US's best scientists, doctors and academics, and the collapse of the health, education and clean water services. After the Iraqi government sows sectarian and ethnic divisions in the country, which al-Qaida terrorists further exploit, giant concrete walls are built to create partitioned ghettos for Irish Cathoics, Protestants, Mormons, born-again Christians, Jews, Muslims, Mexicans, supporters the KKK, and of course communists, for their own protection of course.
My guess is that the 29 Sadrists, holding placards and chanting anti-occupation slogans inside parliament, represented the sentiments of most of the Iraqi people, who were not even shown a copy of the pacts before parliament approved them.
The SFA confirms that the US now has a government in Baghdad which will do its bidding. And here I strongly disagree with my friend Jonathan Steele's assessment in yesterday's Guardian that the Sofa terms "spell the complete defeat of the neoconservative plan to turn Iraq into a pro-western ally and a platform from which to project US power across the Middle East."
The SFA is an open-ended pact, which ties Iraq to the US militarily, economically, culturally and diplomatically. No more, no less. And in case one is pleasantly surprised by the sentence in the Sofa stating that all US forces would withdraw by end of December 2011, reality takes a firm hold in an another sentence, this time in the all-embracing SFA pact, stating that the US would not seek or request a "permanent" military presence or bases in Iraq. It is the word "permanent" which lets the cat out of the bag. How long is non-permanent one wonders? More than half a century, as in Korea? Or 100 years as John MaCain mused?
Jonathan also hails a clause in the Sofa regarding prisoners:
… no Iraqi can be arrested by US forces except with permission from Iraqi authorities, and every Iraqi who is arrested in these circumstances must be handed to Iraqi forces within 24 hours
Any joy over this must be tempered by the fact that torture, Abu-Ghraib style and more, is widely practiced in democratic Iraqi prisons, and many prisoners are killed after summary trials. The underlying assumption, that Jonathan appears to make, is that the Iraqi government is independent. The truth is that "the Iraqi authorities" have become dependent allies of the US forces in their marauding, murdering activities in Iraq.
The Iraqi government made much of the clause that US soldiers would come under Iraqi jurisdiction. The caveats are such that this is rendered meaningless. For a US soldier or civilian to be arrested by Iraqi authorities, before they are handed over to the US forces "after 24 hours," they have to be both "off duty" and have committed "grave" crimes outside US facilities and bases. How many off duty US soldiers, one might ask, would venture into the streets of Baghdad, let alone those of Najaf or Fallujah?
If one considers that the SFA allows the US to "defend" Iraq in case its security is threatened by others, the celebrated clause that the US would not use Iraq to attack other countries becomes ridiculous when one considers that the US attacked and occupied Iraq itself illegally and by trumpeting a big lie. What would stop them concocting another big lie to attack Iran or Syria? Certainly not Sofa or SFA.
I am sure that Jonathan would agree with me that two of the five "preamble" clauses of the SFA are nothing short of what the neocons, whom he declares to have been totally defeated in Iraq, have been aiming for Iraq:
4. Recognising both countries' desire to establish a long-term relationship …
5. Reaffirming that such a long-term relationship in economic, diplomatic, cultural and security fields will contribute to the strengthening and development of democracy in Iraq …
Stripping them of their warm words, that was exactly what the neocons were after: "long-term" domination of Iraq in all fields.
Considering that the SOFA is supposed to cover the three years up to the full withdrawal of the US forces, it is important to note that the open-ended SFA has one "principle" that opens the door for renewing Sofa after the 3-year deadline for withdrawal:
3. The temporary presence of U.S. forces in Iraq is at the request and invitation of the sovereign Government of Iraq
A pro-US, corrupt regime in Baghdad, that is hated by its own people, will obligingly "request" and "invite" the occupiers to stay. That is if the people haven't toppled it by then.
Nothing in the pacts contradict what Obama has said on Iraq. In my article in the Guardian on Obama, before his election, I argued that Obama wanted to keep US bases in Iraq and some "residual forces." I stand by my analysis there.
It is obvious, when one reads the tens of SFA clauses relating to the military, security, cultural, economic, energy, health, environmental, information technology and judicial spheres, that the US is going to impose on Iraq a series of "agreements" during its "legitimised" occupation of the country in the next three years. They will start with the infamous hydrocarbon law to totally control Iraq's oil resources.
Another important point that has also escaped the notice of Iraq analysts is that Sofa not only legitimises the occupation for another three years, it also frees the US occupation from the UN. Without Sofa, the UN security council would have been asked by US and Iraq to renew the mandate of the US-led forces in Iraq for another year. Though the UN has been less than feeble with regards to the occupation of Iraq, the US will no longer be open to pressure from Russia, China, Europe or any other member of the council. This is important if one considers the rising tensions between the US on the one hand and Russia and China on the other. Differences over Iraq, Afghanistan and Iran are also likely to rise between the US, Germany and France. The British government, of course, is likely to remain a poodle.
While it is true to note, as Jonathan does, that the formidable Iraqi opposition and resistance to the US-led forces has inflicted heavy defeats on US neocons' projects in Iraq and elsewhere, it is certainly premature to say that the size of the defeat is such that the US occupation will come to an end in accordance with the Sofa.
My assessment is that that US strategy in Iraq is still being pursued, and is blessed by president-elect Obama. It is a strategy to:
• Strengthen and secure a pro-US government in Baghdad.
• Support such a government by all means possible, including using US combat forces and keeping massive military bases.
• Strengthen the Iraqi armed forces to do the US bidding and replace the US forces in fighting against anti-occupation resistance. This is a strategy similar to Vietnamisation, but it will be pushed forward under the banner of fighting al-Qaida terrorism, which is detested and rejected by the Iraqi people. To further reduce its own casualties, the US will rely heavily on aerial bombardment and Apache helicopter gunships.
• Secure lucrative economic contracts, particularly after forcing the oil law on Iraq. Exercising control over Middle Eastern oil remains a key US objective.
• Use Iraq to back US strategy in the Middle East: escalate the war in Afghnistan/Pakistan, strengthen Israel, weaken Iran, Syria, the Palestinians and the powerful resistance in Lebanon.
One achievement of the Iraqi resistance was to force the US neocons to shelve plans to attack Iran, immediately after stabilising Iraq's occupation, and to force them to freeze further "shock and awe" wars against the region's peoples. While an attack on Iran should not be entirely discounted during Obama's time in office, Iran's cooperation over Iraq, Afghanistan, Lebanon, Syria and Palestine will be the price it has to pay to avoid being attacked.
Given the current balance of forces, only a unified Iraqi people, in alliance with other peoples of the Middle East, and supported by the American and British public, could fully dislodge the US-led occupation from Iraq. That, alas, will take more than three years to achieve.

Britain leaves Iraq in shame. The US won't go so quietly

Obama was elected on the back of revulsion at Bush's war, but greater pressure will be needed to force a full withdrawal
Seumas Milne
The Guardian, Thursday 11 December 2008

If British troops are indeed withdrawn from Iraq by next June, it will signal the end of the most shameful and disastrous episode in modern British history. Branded only last month by Lord Bingham, until recently Britain's most senior law lord, as a "serious violation of international law", the aggression against Iraq has not only devastated an entire country and left hundreds of thousands dead - it has also been a political and military humiliation for the invading powers.

In the case of Britain, which marched into a sovereign state at the bidding of an extreme and reckless US administration, the war has been a national disgrace which has damaged the country's international standing. Britain's armed forces will withdraw from Iraq with dishonour. Not only were they driven from Basra city last summer under cover of darkness by determined resistance, just as British colonial troops were forced out of Aden 40 years ago - and Iraq and Afghanistan, among other places, before that. But they leave behind them an accumulation of evidence of prisoner beatings, torture and killings, for which only one low-ranking soldier, Corporal Payne, has so far been singled out for punishment.

It's necessary to spell out this brutal reality as a corrective to the official tendency to minimise or normalise the horror of what has evidently been a criminal enterprise - enthusiastically supported by David Cameron and William Hague, it should be remembered, as well as Tony Blair and his government - and a reminder of the dangers of escalating the war that can't be won in Afghanistan. It was probably just as well that the timetable for British withdrawal from Iraq was given in a background military briefing, after Gordon Brown's earlier schedule for troop reductions was vetoed by George Bush.

But in any case, in the wake of Barack Obama's election on a partial withdrawal ticket, the latest plans look a good deal more credible. They are also welcome, of course, even if several hundred troops are to stay behind to train Iraqis. It would be far better both for Britain and Iraq if there were a clean break and a full withdrawal of all British forces in preparation for a comprehensive public inquiry into the Iraq catastrophe. Instead, and in a pointer to the shape of things to come, British troops at Basra airport are being replaced by US forces.

Meanwhile, the real meaning of last month's security agreement between the US and Iraqi governments is becoming clearer, as Obama's administration-in-waiting briefs the press and officials highlight the small print. This "status of forces agreement", which replaces the UN's shotgun mandate for the occupation forces at the end of this month, had been hailed by some as an unequivocal deal to end the occupation within three years.

There's no doubt that Iraq's Green Zone government, under heavy pressure from its own people and neighbours such as Iran, extracted significant concessions from US negotiators to the blanket occupation licence in the original text. The final agreement does indeed stipulate that US forces will withdraw by the end of 2011, that combat troops will leave urban areas by July next year, contractors and off-duty US soldiers will be subject to Iraqi law and that Iraqi territory cannot be used to attack other countries.

The fact that the US was forced to make such commitments reflects the intensity of both Iraqi and American public opposition to the occupation, the continuing Iraqi resistance war of attrition against US forces, and Obama's tumultuous election on a commitment to pull out all combat troops in 16 months. Even so, the deal was denounced as treason - for legitimising foreign occupation and bases - by the supporters of the popular Shia leader Muqtada al-Sadr, resistance groups and the influential Association of Muslim Scholars.
And since his November triumph, Obama has gone out of his way to emphasise his commitment to maintaining a "residual force" for fighting "terrorism", training and protection of US civilians - which his security adviser Richard Danzig estimated could amount to between 30,000 and 55,000 troops.

Briefings by Pentagon officials have also made clear this residual force could remain long after 2011. It turns out that the new security agreement can be ditched by either side, while the Iraqi government is fully entitled to invite US troops to remain, as explained in the accompanying "strategic framework agreement", so long as its bases or presence are not defined as "permanent". And given that the current Iraqi government would be unlikely to survive a week without US protection, such a request is a fair bet. Combat troops can also be "re-missioned" as "support units", it transpires, and even the last-minute concession of a referendum on the agreement next year will not, the Iraqi government now says, be binding.

None of this means there won't be a substantial withdrawal of troops from Iraq after Obama takes over the White House next month. But how far that withdrawal goes will depend on the kind of pressure he faces both at home and in Iraq. The US establishment clearly remains committed to a long-term stewardship of Iraq. The Iraqi government is at this moment negotiating secret 20-year contracts with US and British oil majors to manage 90% of the country's oil production. The struggle to end US occupation and control of the country is far from won.

The same goes for the wider shadow of the war on terror, of which Iraq has been the grisly centrepiece. Its legacy has been strategic overreach and failure for the US: from the rise of Iran as a regional power, the deepening imbroglio of the Afghan war, the advance of Hamas and Hizbullah and threat of implosion in Pakistan - quite apart from the advance of the nationalist left in Latin America and the growing challenge from Russia and China. But at its heart has been the demonstration of American weakness in Iraq, the three trillion-dollar war that helped drive the US economy into crisis.

No wonder the US elite has wanted a complete change of direction and Bush was last week reduced to mumbling his regrets about the "intelligence failure in Iraq". For Obama, the immediate foreign policy tests are clear: if he delivers on Iraq, negotiates in Afghanistan and engages with Iran, he will start to justify the global hopes that have been invested in him. If not, he will lay the ground for a new phase of conflict with the rest of the world.

by: Nick Mottern and Bill Rau, t r u t h o u t Report
When Barack Obama becomes president, he will inherit a human rights debacle in Iraq, now entering a phase in which the US appears ready to bulldoze thousands of its Iraqi prisoners over a legal cliff into Iraqi government prisons where they face the possibility of torture and execution.
The darkening future for the detainees comes with the approval on November 27, 2008, of the US-drafted Status of Forces Agreement (SOFA) by the Iraqi Parliament. The agreement requires that on January 1, 2009, the US:
"Shall provide the Government of Iraq available information on all detainees who are being held by them. Competent Iraqi authorities shall issue arrest warrants for persons who are wanted by them. The United States Forces shall act in full and effective coordination with the Government of Iraq to turn over custody of such wanted detainees to Iraqi authorities pursuant to a valid Iraqi arrest warrant and shall release all the remaining detainees in a safe and orderly manner."
On the face of it, the agreement sounds just. An examination of the situation on the ground suggests the opposite.
Sunni Gulag
The US began capturing Iraqis on a wholesale basis in 2003 with the invasion. World attention was focused on the fate of Iraqi detainees by the revelations in 2004 of detainee torture by US forces at Abu Ghraib prison. Because of Abu Ghraib, the US improved the physical conditions of detention, but detentions increased in 2007 as a fundamental tactic of the US military "surge." Iraqis were, and continue to be, arrested on a daily basis, with those deemed not threatening set free.
Since the beginning of the occupation, as many as 90,000 Iraqis have been imprisoned by US forces, according to a spokesperson for Task Force 134 (TF-134), the US command running the US prison system in Iraq. The total number of Iraqis in detention at any one time reached a peak of nearly 26,000 in October 2007, according to figures provided by TF-134. By November 2008, with the reduction in numbers of detentions in 2008 and the release of detainees, the number of Iraqis in US prisons had declined to about 15,900, according to TF-134.
In August 2008, a TF-134 spokesperson reported that approximately 80 percent of the detainees were Sunni. The larger proportion of Sunni captives may result from greater resistance to the occupation in the Sunni community, but it is likely also the result of government forces being under the control of the Shia-dominated government. "Most detainees were captured as the result of an Iraqi-generated warrant for some act that would classify them as a threat," according to a TF-134 spokesperson, commenting on the process leading to capture.
During the debate preceding the passage of SOFA, Sunni legislators, according to Reuters, demanded that detainees without charges against them be freed. As will be discussed, this would free all of the US-detained Iraqis.
No Legal Rights, No Evidence
Iraqi detainees in the US prisons are being held without charges, without access to lawyers and without appearance before any judicial body - all violations of international law. This has been a continuing concern of the United Nations (UN) and international human rights groups, but totally ignored by the US and the Iraqi occupation government.
For example, a human rights report of the UN Assistance Mission to Iraq (UNAMI) released December 2, 2008, said that the agency continues to be concerned about the imprisonment of detainees by US forces "without judicial review of their cases" as well as about "administrative review procedures that do not fulfill the requirement to grant detainees due process in accordance with internationally recognized norms." A UNAMI report in 2007 made the identical point.
A 2006 Amnesty International (AI) report, reflecting the concerns of numerous human rights groups, said: "Since the invasion of Iraq in March 2003 tens of thousands of people have been detained by foreign forces, mainly the US forces, without being tried and without the right to challenge their detention before a judicial body." AI made a similar observation in a November 28, 2008, statement of concern about transfer of Iraqi detainees from US to Iraqi custody.
In October 2008, a spokesperson for TF-134 said in an e-mail: "There is no place for legal representation in the THREAT BASED system that we operate."
Now it appears, based on a November 23, 2008, report from the Associated Press (AP), that the vast majority of detainees are also being held without any hard evidence. The AP said that the US intends to release most of its detainees under SOFA, but that it is "rushing to build criminal cases against some 5,000 detainees it deems dangerous." The report contained the remarkable admission attributed to Brig. Gen. David Quantock, commander of TF-134, that the US has evidence against "only a few hundred" of those detainees considered most dangerous.
"At the end of the day," the AP quotes General Quantock, "if there's not enough facts to justify a court case (in the Iraqi Court system), then we'll have to release ... We have a lot of work to do."
Iraqi Court System Tilted
The basic premise of the terms of the SOFA detainee section, and the reported rush by the US to build cases against detainees, is that the Iraqi judicial system is fair, open and impartial.
Karen Parker, a noted international human rights lawyer, says that the Iraqi judicial system does not meet international standards. The 2007 UNAMI report elaborates on her point:
"Serious pretrial irregularities (in Iraqi courts), which prejudice the chances of subsequently receiving a fair hearing, include the failure to bring defendants before an investigative judge within a reasonable amount of time, and failure to promptly apprise detainees of the reason for their arrest and of the details of the charges and evidence against them ... The vast majority of defendants are represented by counsel appointed by the court, whom they have never met and who have little or no knowledge of the substance of the charges or evidence against their clients ... Proceedings at trial are typically brief in nature, with sessions lasting an average of some fifteen to thirty minutes, during which the entire trial is concluded. Deliberations also typically do not last more than several minutes for each trial, including complex cases resulting in life imprisonment or the death penalty
... Denial of prompt and adequate access to counsel, and lack of continuity in legal representation, mean that in many cases those convicted lose the opportunity to appeal their sentences as they become aware of their rights only after the deadline for submissions has passed."
The UNAMI report noted that trials in the flawed Iraqi court system "are increasingly leading to the imposition of the death penalty."
The Iraqi courts are not able to operate freely, Ms. Parker said, in part because judges and lawyers are often under intense political pressure and even fear for their lives, with the division between Sunni and Shia a major factor.
In January 2008, for example, gunmen assassinated Iraqi appellate court Judge Amir Jawad al-Naeeb, a Sunni, who, The New York Times reported, was considered by Baghdad lawyers and judges to be "one of the country's most competent and even-handed judges."
The Iraqi Lawyers Association reported in 2007 that at least 210 lawyers and judges have been killed since the invasion; that, according to IRIN News.org, hundreds of legal workers had left the country because of threats and persecution, and that:
"With tensions so high in Iraq between the Sunni and Shia Muslim communities, legal workers are being put under intense pressure to make judgments according to religious sect. Lawyers often find themselves in a lose-lose situation."
Jonathan Hafetz, of the American Civil Liberties Union, who is representing two detainees in US custody, agreed with Ms. Parker that the Iraq judicial system does not meet minimum standards for impartiality and due process, and he said that the system is tilted against Sunni defendants. With respect to the detainees, he said the length of time that they have been held without charge is alone a significant enough factor to prevent them from having a fair trial or hearing.

"Danger in the Custody of Others"

Ms. Parker says that international law allows prisoners to be turned over to a justice system only if that system it meets international standards for independence and fairness. In addition, under international law as well as US military standards as set forth in US Army/Marine Corps Counter-Insurgency Manual:
"There are certain conditions under which US forces may not transfer the custody of detainees to the host nation (in this case Iraq-Ed.) or any other foreign government. US forces retain custody if they have substantial grounds to believe that the detainees would be in danger in the custody of others. Such danger could include being subjected to torture or inhumane treatment."
The Iraqi detention system is widely believed to treat prisoners harshly and only slowly, if at all, processes its detainees through the justice system.
"We find a lot of mistakes and mistreatment in the Iraqi-run prisons as a remarkable number of their facilities are not fit for those detainees and those who are in charge do not have enough knowledge of human rights, so ill treatment can occur, " said Basil al-Azawi, who is head of the Commission for Civil Society Enterprises, an umbrella group of over 1,000 Iraqi NGOs, as reported November 17, 2008, by IRIN.
"A suitable life inside the prisons must be guaranteed according to the Iraqi constitution and law. More visits to Iraqi prisons must be allowed by international and local human rights activists, and the treatment [of prisoners] must not be based on their sectarian background," al-Azawi is quoted as saying in a November 2, 2008, IRIN report.

An Iraqi parliamentarian, Mohammed Al-Dainy, held a press conference in Geneva on October 31, 2008, charging that Iraq has 420 secret detention centers where "conditions are much worse than in the official prisons." He said that 40,000 are being held in Iraqi government prisons and that this is one-quarter of the total number of people being held by the government.
The UNAMI 2007 report indicates that mistreatment of prisoners in Iraqi custody is a long-standing problem. The UNAMI, the report said, "remains concerned about the continuing failure of the Iraqi government as a whole to seriously address issues relating to detainee abuse and conditions of detention ... The authorities have yet to demonstrate the political will to hold accountable law enforcement personnel suspected of involvement in torture and other abuse of authority ... The continuing failure to take decisive action in this regard can only serve to encourage the climate of impunity that prevails today ..."
Visiting a National Police detention center in the northwest Baghdad suburb of Kadhimiyah in July 2007, Molly Hennessy-Fiske reported in The Los Angeles Times that the facility had been built to hold 300 detainees but that it then held nearly 900. She observed:
"The stench of human confinement intensified as the guard led the way to the back of the room and down a dark, flooded hallway to the bathroom, where half-naked detainees stood barefoot amid muddy puddles, broken floor tiles and stopped-up urinals. A shower and sink were filled with human waste.
"The guard dropped his cigarette butt in a puddle as detainees relieved themselves in two holes and rinsed off under a broken water pipe."
Hennessy-Fiske said that "Col. Daniel Britt, who heads the US military's National Police Transition Team, which advises the detention center staff, said the conditions were 'appalling' but met international standards. US soldiers visit almost daily ..."
In May 2007, Joshua Partlow reported in The Washington Post that Deputy Justice Minister Pusho Ibrahim Ali Daza Yei acknowledged overcrowding in Iraqi prisons, and the article went on to say that it had been reported that "beatings and torture are common." An anonymous UN official was quoted commenting on one Iraqi jail:
"Routine beatings, suspension by limbs for long periods, electric shock treatment to sensitive parts of the body, threats of ill treatment of close relatives. In one case, one of the detainees said that he was forced to sit on a sharp object which caused an injury."

The 2008 UNAMI report affirms that gross mistreatment of detainees continues in Iraqi prisons:
"Ongoing widespread ill-treatment and torture of detainees by Iraqi law enforcement authorities, amidst pervasive impunity of current and past human rights abuses, constitute severe breaches of international human rights obligations and represent examples of challenges faced by the Iraqi government."
Los Angeles Times staff writer Tina Susman, reported in September 2008 that she interviewed prisoners in Iraqi government jails who had been held for 18 months and longer without access to any judicial hearing or explanation of their detentions.
In the Kurdistan region of Iraq, security forces known as Asayish operate control of the regional government's Ministry of Interior, according to a 2007 report by Human Rights Watch and based on research conducted in 2006. HRW interviewed many former detainees and reported that the system regularly violated Iraqi and international law. The report lists violations, including "... failure to inform detainees of the grounds for arrest, failure to bring detainees before an investigative judge in a timely fashion, failure to provide a mechanism by which suspects can appeal their detention, failure to provide a trial without undue delay, failure to provide access to legal representation, holding suspects for prolonged periods of pretrial detention, and extracting confessions through coercion."
An amnesty law passed by the Iraqi parliament in February 2008 was supposed to facilitate the release of Iraqi prisoners, but the process has been very slow, with only several thousand having been released, according to Susman's informants.
Currently, the US funds lawyers and trains Iraqi judges in order to improve Iraq's justice system. (The US has spent $50 million on Iraqi court facilities and $10 million in training lawyers.) However, that funding could stop with changes arising from the new security agreement. One Iraqi lawyer told Susman, "If the Americans stop providing the money, I don't think the Iraqi government will sponsor us."

Third Party Solution
Ms. Parker said that under international law, when the US arrests an Iraqi, it has the responsibility to make specific charges and state whether the detainee is being held on criminal charges or as a prisoner of war: "Basically, people 'detained' for reasons related to an armed conflict have a right to challenge their status - either as POWs (prisoners of war), civilian detainees or those with criminal charges."

All, she said, must have legal representation, be provided with legal counsel if they are indigent and have a forum for their defense that meets international judicial standards.
Ms. Parker cited a UN draft guidelines and principles document on human rights and terrorism, prepared by Kalliopi K. Koufa, Chairperson-Rapporteur of the Working Group on Human Rights and Terrorism of the former UN Sub-Commission on Human Rights, laying out rights of a person arrested as a terrorist, which include:
"Persons detained under suspicion of engaging in or planning terrorist acts at all times have the right to know the charges against them. A charge of being a terrorist is insufficient and must be accompanied with charges of specific acts."
International standards also require that a prisoner facing criminal charges must not only be represented by legal counsel, but must have his or her case presented in a judicial proceeding within four days, Ms. Parker noted, although there have been attempts to extend that period somewhat in terrorism cases.

If a person is held as a prisoner of war or a civilian detainee, Ms. Parker said, he may not be held in prisons, but in camps "that meet minimum Geneva Conventions standards." The Conventions spell out a highly detailed list of POW rights, including legal rights, the right to wear their own clothing, not prison garb, and protection against abusive interrogation.
Since the Iraqis in US prisons have been offered none of their rights under international law to challenge their confinement, Ms. Parker said, all the detainees should be released.
If this is not done, she continued, the next best alternative might be to have the detainees moved to a third-party country where hearings can be held before an internationally recognized judicial body. If detainees are held after their hearing, the US would have to place them in a facility in a country in which their rights would be protected.

Stakes Higher in Iraq
President-elect Obama is reported to be seeking a way to try prisoners from the US Guantanamo Detention Camp in US courts to at least give the impression of trying to achieve justice, however belated, for about 250 detainees. In Iraq, the stakes are higher for the US military and the Iraqi occupation government, who aim to keep off the streets thousands of people they view as threatening.

In addition, Ms. Parker said, the US wants its Iraqi detainees put into Iraqi prisons "to have one more step between them (the US) and a lawsuit," pointing out that the failure of the US to provide the Iraqis with due process makes it vulnerable to legal action by international human rights lawyers on behalf of the detainees. The transfer of the detainees, she said, "gets us (the US) off the hook." It is part of a "mad scramble," she said, in which the Bush administration is "hot and heavy covering its tracks."

Ideally, the UN and perhaps the European Union will intervene, demanding that all US detainees in Iraq be given amnesty, based if nothing else on the fact that they have been denied their legal rights. At a minimum, these bodies could call for open hearings in an internationally supervised court in which detainees would have legal representation.
The international community has proved ineffectual to the Iraqi detainees so far, however. Their hope most probably lies solely with their families, friends and supporters who will oppose their illegal disappearance into Iraqi prisons.

The Iraqi authorities are already holding thousands of people, many without charge or trial, and often in appalling conditions. Many have no access to lawyers. Others have been sentenced to death after trials which failed to meet international fair trial standards.
The US is currently reported to hold around 16,000 prisoners in Iraq. Most are detainees who are held without charge or trial, some for more than five years, and without recourse to any independent review of their detention.

We women of Tadhamun condemn the persisting practice of arbitrary arrests by the Iraqi security forces. We condemn their arrests of women in lieu of their men folk. These are 'inherited' practices. We are alarmed by credible media reports of the Green Zone government’s intentions of executing hundreds of Iraqi men and women.

Samarra Minrate built in 852 AD

Samarra Minrate built in 852 AD
Building of 1 500 massive police station !
From the angle of the photo, it is possible to calculate that the complex is being built at E 396388 N 3785995 (UTM Zone 38 North) or Lat. 34.209760° Long. 43.875325°, to the west of the Malwiya (Spiral Minaret), and behind the Spiral Cafe.
While the point itself may not have more than Abbasid houses under the ground, it is adjacent to the palace of Sur Isa, the remains of which can be seen in the photo. While the initial construction might or might not touch the palace, accompanying activities will certainly spread over it.Sur Isa can be identified with the palace of al-Burj, built by the
Abbasid Caliph al-Mutawakkil, probably in 852-3 (Northedge, Historical Topography of Samarra, pp 125-127, 240). The palace is said to have cost 33 million dirhams, and was luxurious. Details are given by al-Shabushti, Kitab al-Diyarat.
Samarra was declared a World Heritage site by UNESCO at the end of June. The barracks could easily have been built elsewhere, off the archaeological site.--
